Dear All,

I am a Canadian Citizen since 1993, due to my family issue, I left Canada in 2000 and without pay my tax around 35000 CAD.
Now, I want to return to Canada, do you think they will set my case to crinimal? How can I check my tax record status?
Can I return and apply to pay back by installment?

Since I got married in my country and want to bring my wife and daughter back to Canada, please let me know what should I do?

You can call the CRA (1-888-863-8657) to discuss your situation, but I would advise seeking an accountant's assistance. I would say it is unlikely that they will pursue a criminal tax evasion case if you're proactive and contact them on your return.

You can negotiate a payment plan with them - your taxes owing in $35,000 would be subject to compound interest since 2000 (9-10%). By law, they cannot (easily) waive the interest, as the provision for waiving interest has a 10 year limitation. If you want to arrange a deferred plan, you will need to be able to demonstrate that you cannot pay the amount upfront (i.e. bank statements, etc.).

It may be worth talking to an tax accountant that can help you negotiate terms with the CRA. There are some voluntary disclosure options DEPENDING on the nature of your taxes owing (you may still be able to get relief on your interest). A knowledgeable account can assess your situation and help you get back on track :)

Only if there's a criminal warrant out (which I consider highly unlikely). The CRA has many other (civil) tools available before it goes to that route.
