If someone applied for a spouse visa to U.K. 5years ago and it was denied and he appealed the decision and the appealed was successful, what should the person thick in the CIC spouse visa form that ask if he has been denied visa to any other country before? I was thinking to say no bcos the appeal was granted.. Your opinion will be appreciated. Thanks
 
Answer `Yes', because that's the correct answer; he WAS refused. It wasn't until the appealed the refusal, that was eventually successful, that finally gave him the visa, right?

Just include a brief explanation. IMO, this is the safest option.

Oh my God.. I answered no and I have already sent my application and I have AOR1 already. Can I fill out a new form and send it back to them explaining the situation. I don't want them to see it as misrepresentation

Don't panic. If your application doesn't give the details of the previous situation you could send a note with additional information.
Explain any information which wasn't clear or wasn't included.

Thanks. I can sleep in peace tonight. I will do just that first thing tomorrow. Can I email them or I should do it by mail?
 
If someone is rejected during the process of PR for a visa, should he notify cic about it?

They always write Do Not Reply to this email address when they send emails.
So I don't know of any email address you would send it to.

Maybe other people can weigh in with an opinion.

If I had to send a correction or additional information by mail I would do this:

1. Send it to the address given for courier delivery, so that it's hand delivered and signed for
You can get this service at Canada Post called Priority Courier or by the big well known couriers

2. Make sure you mark very clearly the APPLICANT'S NAME: and the SPONSOR'S NAME
at the very top of the sheet clear and nice block printing
At this point you don't have a file reference so that is extra important.

3. Explain everything about the situation, but I don't mean to take too much space.
One sheet should do. I applied or He or She applied in May or whenever 20xx for a Whatever type of Visa it Was
to the UK or wherever. Received a reply Denying the Application

In Oct 20xx filed an appeal of this decision
On Dec xx 20xx received approval of appeal
Visa was issued on whenever it was and He / She then moved to ......


Make it clear about the dates and the actual legal finding first a refusal and then an appeal then won approval

don't make it emotional or rambling
 
I still think you need to send a new form, because you answered incorrectly on the original...and then include the explanation.

Sending a note now, will not change the fact that the answer on the form that you signed, was incorrect.

Your AOR1 will have given you a file number and a UCI.

Fill the new form and attach a brief explanation on a separate sheet- make sure you include both names, your file number, UCI, spouses UCI if they have one and your contact information.

Send a physical copy to CPC-M and send a case specific enquiry as well.

When your file is transferred to the processing VO, send a copy to them too- just to be safe.

when you say fill a new form, do you mean the entire application form or just the background form where I made the mistake?

Secondly, I'm thinking weather to wait until my file is transferred to my local VO before sending them the new corrected form.

Yes, which is why it is critical that the OP send a new [completed] replacement form, including signature.

Sorry Ponga let me rephrase what I actually meant.....Assuming the answer given was YES and detailed explanation of all visa refused were not stated(i.e. Some were stated). Would that amount to misrepresentation?
