Hi

Iam temporary resident closed work permit which going to expire August 28, 2026 ,
My wife has visitor record which going to expire same date August 28,2026

As of now ,
I have only approved LMIA + my current work permit and it's going to expire in August 28 ,2026

And my company going to apply for my new work permit at the first week of August

Then I will get letter for maintained status

So based on that , is there a good possibility to apply for my wife VR extension ?

And if the application got rejected can we re-apply for restoration of status as a visitor While she is still in canada ?

Also i would like to mention that my wife been her dor almost 3 years we we have a Canadian child and my wife is currently pregnant , also i have got OINP invitation and my application still in submitted status .
Any info here can help to built an explanation letter?

What type WP are you applying for? Do you have AOR for the OINP. It is pretty surprising that your spouse has been able to renew her visitor record for so long and she may not be able to keep on extend it. 3 years is not a visit. She also should not qualify for OHIP so tough to justify why a foreign national without OHIP should remain in Canada throughout a pregnancy. You can certainly try but how much money you have to pay for her healthcare should also be a consideration for you and for IRCC.

Close work permit, yes I do have AOR ,

My wife had SOWP before for 2 years then due to delay in my WP process my wife extension got rejected and I have to restore her status as visitor due to change in SOWP as my NOC is tear 5

So iam looking to extend her VR

I was able to manage her healthcare during that time , she is one month pregnant so fare

IRCC and hospitals are much more strict than they used to be about foreign nationals remaining in Canada as visitors longterm or access to healthcare as provinces crack down on who can access healthcare for non-emergency purposes and as hospitals run deficits. Your spouse doesn’t have a pathway to remain in Canada in the short term except as a visitor so that makes the argument that she should be able to remain as a visitor much more difficult. If your argument is that she had been able to access free midwifery care in her previous pregnancy, although that is a provincially paid for service, then that is not a great argument that you will be able to pay upfront for any healthcare she may need. You should be able to show significant savings at the very minimum if you are arguing she should be able to remain in Canada as a visitor while pregnant so you could pay for any costs that do arise with pregnancy. There is also a fairly good chance that she may be refused and run out of options before the end of her pregnancy. What is your NOC? What are your chances of getting an ITA for OINP? You may also not get a new WP even if you employer was able to get an LMIA. What once was possible has become much harder especially for teer 5 jobs. Realistically you need to have a plan for at least your spouse to have to return to her home country for at least a short period of time. How long has she been a visitor and when did she last apply and receive a visitor record? Was this her first extension?

Your wife’s status and ability to remain in Canada will likely come down to how quickly you can obtain a BOWP and then an SOWP for her. The change of SOWP rules were meant to make spouses leave Canada not remain as visitors. Given that your spouse has already spent quite a long time as a visitor in Canada there are high chances any further attempts to remain in Canada as a visitor will be refused. She is also attempting to live in Canada as a visitor which is not the point of visitor permits. All you can do is attempt to extend her status but also have a back-up plan in case she does need to leave. You also need to be examining your finances and evaluating whether you could afford substantial medical costs since she does no have OHIP. Could you pay tend of thousands of dollars if necessary? Hundreds of thousands? Although hundreds of thousands is rare it still happens. Tend of thousands spent on healthcare for pregnant women is fairly common.

Tough to say but probably better than nothing. How much savings you can show may also have a big impact especially given the fact that your spouse is pregnant. IRCC is more likely to want to see that you would be able to cover any healthcare costs whether planned or unplanned and not place additional strain on the healthcare system which is somewhat inevitable. You will also have to pay attention to any provincial changes or hospital/healthcare practitioner specific changes when it comes to accessing healthcare as a visitor. Many provinces and hospitals are becoming much more strict about this issue because they are running deficits and also want to make remaining in Canada more uncomfortable for people who don’t have permanent status or valid work/study permits. The big issue is that your spouse is trying to live in Canada as a visitor and Canada has been very clear that it is trying to reduce the number of temporary residents that don’t have valid study or work permits. Your spouse was already on a limited timeline to remain in Canada. The fact that this appears to be the second child she is attempting to have as a visitor does not help her case. Fighting to remain in Canada may also not be the best option if she wants to get an SOWP because that is still a temporary permit and if she has tried to remain in the past as a visitor there could be concerns that she will not leave in the future. Would suggest meeting with an immigration lawyer for advice about your case because it has become quite complex.
