Hello, I have a question and would be very thankful if someone knowledgeable could shed some light on:

My girlfriend who has been in the country for 6 years now received her CoPR through and LMIA that she submitted with her employer.

Now that she has the CoPR we are going to her home country in Europe for 5 weeks to see her family.

The issue is that she submitted her resignation from the company (for many reasons, they don't treat her well and she is forces to work weekends without lay as a tour guide since she is salary based employee and many other reasons)

I'm worried that she will have problems when returning to Canada and getting her record of landing.

Is it OK to quit a job which submitted LMIA after getting CoPR but before actually getting to the border to do the record of landing?

Thanks for your time..

I would complete the landing before she does anything. You can fly somewhere close like the U.S. and come back and do the landing. Alternatively you can drive to the U.S. border, enter the U.S. (or if you don't have a U.S. visa the Americans will give you a little form that says you only want to flagpole and send you back to Canada.) You can do the landing once in Canada. (For landing, avoid a busy Canadian border, try something smaller/with less wait times.)

Has anyone else ever heard of this situation? It's not like they are calling up the employer to see if she really works for them. Her closed work permit is specifically for that company. By the time the plane lands the office will be closed and it's not like they will keep her there all night just to confirm she has a job

How did she apply for PR? Through Express Entry? PNP? Something else?

It was a risky decision to quit her job before landing - sort of makes it look like she used the company just to obtain an LMIA and get PR. CBSA won't check with the employer at landing - but it's possible the employer could proactively notify CIC about what has happened. Hard to know what CIC would do in that case - and that might depend on the program she applied through. Quite possible CIC will do nothing.

She will likely be fine - but always some chance this could create problems.

Anyway - what's done is done. Not much she can do at this point but land and assume everything will be OK.

Has she submitted her resignation letter or is she not working at all anymore?
In any case, what the person above suggested, before she stops working and travels outside of Canada, it would be best if you can do your landing.
Do a flagpole in Niagara, sarnia or thousand island, it just takes a day and she can officially land in Canada.

She should land as soon as possible. As scylla said, the employer may contact IRCC and that might result in a negative action against her.
