Its an urgent query. Your suggestions, comments or links to any info are most welcome.

I am working in Ottawa, open WP and shall apply for CEC PR in 1st week of Feb' 2013. My husband works in USA, H1B visa.
There are high chances that I will have to move to USA at the end of Feb. My questions are:
1. Is it possible that I apply for CEC PR from within Canada, and can move to states (for a longer duration like 1 year)? What are the pros and cons of doing this. Also what could be done in this situation?
2. Also I found on website that I could apply outside Canada, but how is it going to affect the processing time and police clearance done from Ottawa etc.

Of course you can move after you apply, there's no requirement to remain in Canada. All you have to do is inform CIC of your change of address.

If you are approved, you would have to "land" by a specified date after receiving your visa, but you wouldn't necessarily need to relocate back to Canada at that time. But you would have live in Canada for at least 2 of the following 5 years, or lose your PR status.

You can apply to the visa office that serves your country of nationality, or your country of residence if you have been admitted for at least 12 months. In the case of the USA vs Canada, there's no difference- same visa office (Ottawa).

If you're talking about another country (e.g. applying to New Delhi], there is no current data on how long that will take. Just remember, if you're approved, you'll have to send your passport there...

I got married recently and my husband works in USA. Now we are planning to add him as dependent in my application.

A situation that's arising is my husband's birth certificate (that is being in process to obtain from India) is going to take couple of weeks... :(
Should I apply without him added in application (applying at end of Jan) and add him later? Is this going to increase the processing time significantly??? I am talking about months here (otherwise we wait for BC, another 2-3 weeks).

Please anyone who has any experience or info, your suggestions are welcome.... :)

No, this would be misrepresentation. You are either married at the time you apply, or you are not. If you are, then he must be included in the application.

Do you already have the police clearances for both of you? Those can take soem time as well. If it's only going to be a couple of weeks for the birth certificate, then I suggest you wait.

In my knowledge CIO doesn't require PCC so we can send his PCC after 2-3 months (its going to take this much time to get one for him) to VO. I have mine obtained. We urgently require his BC since it has to be sent with the initial application.
I am wondering if my husband's High School Certificate can be used as BC? Any thoughts....

Nowadays lot of applications are being rejected due to BC problem
try to get the original certificate from india, else in the worst case produce an affidavit.

It is preferred that PCCs are sent with the initial application, but you're right, it's not absolutely required and they may be sent later.

I have to ask, tho, that you need a PCC for every country you've lived in (except Canada) for at least 6 months, since the age 18? I ask because you said "PCC" in the singular and not plural, so I just wanted to be sure you understood. Your hubby will need the PCC from India and probably the USA (FBI) as well... you too, if you lived in the States before...

Yeah I would like to take the least resistant path...and wait to get BC from India.

However could you please tell more about the affidavit...What has to be written in it and from where we need to get it...Just in case if getting BC from a small town like mine becomes cumbersome/lengthy.

Yeah I need only one PCC from India. My husband will need from USA and India...and this is why we are expecting a longer waiting time...:(

Not really, other than this Q&A post from David Cohen, the lawyer who runs this forum - he states that school certificates that have the same information (your full name & DOB, mother & father's name) will be accepted - this is specific to India, I believe.

I can't copy and paste it so you'll have to go to the site and read the third question and response. This was posted just last summer, and I have no reason to believe it has changed, but I can't guarantee it, either.
