Good afternoon folks. First some background. I am an Indian citizen married to a Canadian citizen and have been living in the states for more than 10 years. I recently came to Canada to get the H1B visa stamp and was put under 221(g) administrative processing. Thankfully I have a visitor record in Canada until May. But it looks like I may be stranded here for the long haul and my options are very limited.

We will be filing for PR using spousal sponsorship and we have most but not all the documents. Most importantly I am waiting for the FBI background clearance (which won't come until March 2016). I also need to get PCC for India. My questions are:

1. Would the Indian High commission be able to issue me a PCC, given that I am not a resident of Canada and only have visitor status here?
2. If not, how would I go about obtaining PCC from India while I am staying with my wife?
3. Will CIC accept our sponsorship application package w/o these PCCs and allow us to add them to our file later?

If my H1B is approved soon, I can get the India PCC from New York consulate in one day, but I want to be prepared for the worst case scenario that I won't be able to go back to the states again.
