Hello,

Some Background:

I am a 24 year old Bangladeshi citizen, that is currently undocumented in NYC. My family came here on a visitors visa when I was 7. I have a Bachelors and Masters in Electrical Engineering. Due to my status, I cannot work in the US, and can no longer move forward with my life here. I want to try to apply for PR in Canada, but I have no work experience, and engineering is not one of the needed skills listed. My only chance it seems is to secure a permanent job in Canada. I went through the mock application/points forms, and If I get arranged employment, I should have enough points to be eligible.

My question(s):

It is it feasible to somehow get hired by someone in Canada and apply for PR, despite my undocumented status in the US? Also I'm confused by the term "arranged employment". From what I gather, not only do I have to get permanent job offer but it has to be approved by the HRSDC (Human Resources Social Development Canada). What does that entail exactly?

Does anyone have any experience with the ins and outs of arranged employment? Any advice is appreciated.

Arranged employment is someone from Canada(canadian company) hires you as a foreign worker, they then sponsor you for a work permit but they will have to go through HR Canada to see if they are eligible to hire a foreign worker against the position they will be hiring you for.

Secondly, and most importantly...are you in the US? Cuz i don't think you can apply for a work permit from the US....you need to have some kind of a status to apply for Canadian visa be it visitors visa or any other...

So I have to acquire a work permit before I can apply for PR, if I want to go the arranged employment route? I thought work permit would come following a PR approval.

Also whats the process for HR Canada approval? I have been told by a family remember that the company has to list the job for 3 months, and if it remains unfilled, only then the company can go forward and hire a foreign worker. It this true? I tired searching for information on it, but everything is very general.

I am currently in the US. Yes I know that getting any type of visa is impossible from here. Hence I was trying to go the PR route.

For AEO - you must find an employer who is willing to offer you a job in Canada if you are accepted for the Federal Skilled Worker program. The employer is the one who has to obtian a positive AEO from HRSDC.

To qualify to apply through Buffalo, I believe you must be able to prove that you were legally admitted to the US for at least one year. I'm not sure you qualify based on that requirement. I'm fairly certain that a US visitor visa would have only been issued for a period of less than a year (unfortunately it doesn't count if the visitor visa was extended - it's how long you were allowed into the country for when you first arrived). If that's the case, then you can still apply, but your visa office cannot be Buffalo.

Hopefully you are also aware that as soon as you leave the US, you will be banned from the country for a period of 10 years. Having Canadian PR or even citizenship won't change this. Just want to make sure you know this consequence in case you have family there you may want to visit.
