I found a few posts answering some of my questions, but I was wondering if:

1. Anyone has obtained a student visa to Canada after being unlawfully present in the U.S.. When I say unlafully present, I refer to having entered the States without legal inspection (not overstaying your visa).

2. If so, did you apply from the U.S. and sent your application to the Canadian Embassy back in your native country?

Is it even possible to apply while in third country, and send application to your home country? I have the same situation, and I thought you cannot do that because you will have to go to your country of citizenship for an interview. Anyway, would like to see if anyone was able to do that.

You need legal status in the US to get a study permit from Buffalo, read http://www.canadainternational.gc.ca/buffalo/imm/visa_temp.aspx?lang=eng#REQUIREMENTSUS
 
Must the principal applicant AND spouse show legal status? I'm a USC but my spouse is not. So I'm thinking he will get the work permit if we send it in together with my study permit applicaiton. But will they grant him the TRV also?
