My husband came to Canada in 2023 on a study permit with the intention of starting school in September. However, he did not end up attending school. Instead, he began working without authorization and has remained in Canada since that time also working the same job since then. We met in summer 2024.
We are now legally married, live together and have submit a thorough spousal sponsorship application. After we got the aor we applied for the work permit (as the lawyer told us we could) but it was refused. We have spoken with a lawyer who advised (as did the refusal letter) that he may need to return to his home country or stop working, but we are unsure about the best course of action given our financial situation and the risks involved.
The lawyer said it’s because we didn’t include a letter of explanation. She didn’t tell us we needed one and we also didn’t think of it but the reason for refusal says something else anyway.
Could we reapply with the explanation letter?
The refusal letter for the work permit said that his pr application was not yet at the eligibility stage to grant him a work permit.

However, GCMS search revealed client is No Longer Registered/Enrolled as of December 15, 2023. Client is requesting an open work permit and has submitted an application for permanent resident under the spouse or common-law partner in Canada (SCLPC). Client’s APR has not yet passed eligibility. As eligibility is not yet passed, client is not eligible to work permit issuance. Application refused as per R207. Refusal letter sent and client advised to leave Canada. Open work permit fee refund initiated.
Do we wait until then to apply?
Or does he definitely quit and go home for some time ? How long would that be potentially?
We have 3 kids, pets etc I can’t hold us down financially on one income.
