My friend's wife is the principal applicant for a TWP. Her LMO has arrived. She is 30 days pregnant now.

1) After applying for TWP, will she be allowed to take the medical exam?

2) She will give birth in Canada. How can she obtain a legal status for her child after giving birth in Canada?

Medical is required for visa if her country needs one.
Child born in Canada can swear to be a Canadian citizen when reaching 18. Before that, the child is entitled to all other rights except voting. However, that wont give the mother any advantage for staying in Canada. Mother has to renew her permit as usual and there is a 4 year limit for her to work in Canada. should the mother leave Canada, the child should leave with the guardian.

1. A child born in Canada is a Canadian citizen, unless one of the parents is a diplomat. There is no "swearing of citizenship at *"

she will has to check with the doctor after she gets medical request.most of doctors will not allow her to do x-ray as part of the medical exam but it will depend on the pregnancy stage.
as for your second question,if medical is delayed due to her pregnancy this means visa will be delayed as well hence no child will be born in canada.
what is your friend's country of citizen?

I dont agree with this....being pregnant does not delay medical in any country. It is correct that the doctor will not perform x-ray but this will not cause any delay in visa.
If visa is approved, and you deliver in canada - your child will be Canadian by birth as PMM said.

Hi vermanaman,

if doctor can't perfom X-ray during pregnancy then he will not send medical report the the RMC(regional medical centre)where it will be processed by a medical visa officer and forwarded to the visa office for review by a visa officer.
in another a medical with x-ray is incomplete hence the visa can't be issued until a complete medical is done,otherwise what's the point of CIC asking for the x-ray test as part of the medical exam.

in another word CIC will hold her work permit application until she delivers her new born and complete her x-ray,im very sure about this information you can check with a lawyer or even ask CIC if you want.

Thank you for the comments so far.

If in case, we find a way to have the chest x-ray done, will the applicant be granted a visa? will the pregnancy be a deterrent?

I agree that the govt health won't kick in until 90 days after landing, but can we show a health insurance copy as assurance that we can meet any medical emergencies in Canada before the health care kicks in?

I guess we don't have to worry about the legal status of the baby as it will be Canadian and hence will be legal to remain in Canada.

you are welcome,

if you get the x-ray done then yes the visa will be issued,but if she is in late month of pregnancy she might face problems with airline companies,a lot of them refuse to allow pregnants in their last month to board an airplane.
as for health care coverage in canada,this will depend on the province where she will be settling in,i know in alberta your coverage starts on day one you arrive,british columbia and ontario for example you have to wait for 90 days.
if she is not covered until a period of 90 days is passed in that province and she expects delivery during that time then she has to get her own inssurance because delivery expenses are very high in canada.

I read that a pregnant applicant will need to wait after she delivers her baby before she can be granted her visa.

I know some one whose child was born in Canada in Sep 2013 and they moved around Mar 2013 on work permit and spousal open work permit to Canada.

They received visa around Feb 2013 and applied around dec / jan, so i guess pregnancy already commenced and must have been in doctor's notice when they went through medicals.

They didn't have any issues, child was born in Canada plus although the 3 month waiting time applies for receiving general health care, pregnancy related issues, being already on the mother's file were excluded and it was approved that if any pregnancy related emergency comes before 3 months, it will be COVERED by canadian health care.

My friend's wife will land in Alberta, so I guess no issues with medical coverage as well.

In summary, if they can get a chest x-ray done with the panel physician's consent and all goes well, their work permit 'should' be approved.

Correct?

1. CHC may contact the employer to determine if the job is still open if the applicant is pregnant.
