I have probably mentioned my situation here before. I entered in the US with a 6-month tourist visa. I overstayed it. Then, I was out of status. Then, I received my work permit valid for 3 years. Within these three years, I went to my home country to visit my family. When I came back, I was issue another I-94 for parole giving me 1 year to adjust my status. Then, after the 1 year period passed, I could not renew my work permit, then I became once again, out of status which I have still been so far. I want to apply as skilled worker. However, I have asked a couple of attorneys and they give me different answers as for applying here in the US or in my home country. One said that I could apply here in the US since I was legal for at least 1 years. The other said that I could not apply because I must be legal at the time I apply and I am not. So, now I do not know which one is correct. Please give me some light.
 
You have to ask the visa office directly or try to apply and see if you go through.
 
The visa office ignores your current legal status in the USA, but to qualify to submit your application in the USA you must have legally been admitted to the USA for at least 1 year (which according to your note, you did). I was in the same situation back in 2003 and am now a Canadian PR since 4/2007.

How lond did it take for them to ask you proof of funds after you sent them the application? I do not have the whole amount now and I am not sure I should apply now.

I don't have the money either ($20,000) and that didn't stop me of summit all the applications available, FSW or Alberta H1B Program, I'm now an expert of put everything on ebay, cragilist, amazon, garage sales, etc. little by little is coming, also I do video weddings on the side, put our old clothes of our daughters on consignments sales, etc. make things happen.

On the application, they ask how much we have. How much did you put in there since you do not have the money right now?

$20,000 that's what I put on it, that simple. According with the table we're 4 people, how many are you?
 
I would make sure that you can prove via official statements/documents that you have the funds available to you during your interview, if called, and at landing. This could be a recent bank statement or investment. If I remember correctly, the visa officer did ask for proof of funds during the interview.

You just have to prove that you were legally here in US for 1 year which you should not have any problem. You are qualified to apply for Skilled Worker PR Card.
 
They can also ask for your funds when they ask for your medicals and police report.
