Hi all.
I need your advise.
I have applied in Jan. 2007 as skilled worker simplified application and got file number that is IN PROCESS, but as you know in simplified form they didn't get any supporting documents that time. they said 4 months before starting assesment they will contact to send supporting documents so as now they are processing 2005 applications it takes about 2 years to reach my 2007 file.
after changing rule. I applied again in May 2009 under fast track system and got approved by Sydney CIO office. then I send my complete Supporting documents to visa office and last week I got my visa offcie file number. new file numer status is "Recieved by visa office".
I didnot withdraw my 2007 file and now I have two applications in the same time but first is still in queue.
Now I am worry about what they will decide when they start to process my recent file? do they reject my new file because I had privous file or having two applications in the same while both of them are not in proccesing stage is possible.

That is no problem.

8) Can applicants have both a pre-C-50 FSW application and a C-50 application?

Yes, applicants may have multiple FSW applications. The applicant can choose to either maintain the first application and submit a new C-50 application with a new processing fee; or withdraw the first application and submit a C-50 application. If an applicant chooses to withdraw their pre-C-50 application before processing begins, they will receive a refund.

Missions should inform applicants that they cannot advise whether the original FSW application or the C-50 application will be a faster process. Missions should avoid recommending a particular course of action to applicants.

So as my new file under new rule will process faster than my old file, it is not matter for them my old file.

It is all fine.. You can have two applications in parallel without withdrawing any provided you have declared in your 2nd application that you already have one "in process" application in one of the Forms.

No I did not declare my 1st application in 2nd application, because as I remmeber there was no section in the forms for this subject but now when I check my online status with 3 file numbers (one for old file, one for CIO and last one for the Visa office),all they go to one page and there are two line one IN PROCESS for the old file and the other "Recieved by visa oofice" for the new one. I think it is not important to declare previous file because they have my complete history.
 
Hello mate,

if you look at background declartion form question 9 Option 2 will ask you if you already have applied for PR in canada and you should have said yes..and if you have said "No" they will assume that you don't have any other application. I suggest that you write them explaining your mistake and declare it now otherwise if they find it out they will reject your application based on False declaration..

Yes you are right. I did not answer Yes to this question. Now do you mean I have to send this form again by mail to visa office or just correct the form and email to visa office?

I guess you can write a letter to them stating your mistake and give your previous file number(as requested in the form) in that letter..
You should send this letter ASAP.

Yes, you do need to let them know NOW! Otherwise it would be considered mis-presentation.
 
The schedule 1 question 9 everone tends to answer without even reading the minute details of the questions. This is a common problem and many have made this mistake. I suggest you send an updated schedule 1 form with the correction made. Write a polite covering letter that due to an oversight you answered question 9 subsection b wrongly and that you apoligise for the error. Please kindly update your records accordingly. All will be fine as far as you tell them before they find out. Keep copy of what ever you send to chc delhi.

I sent My corrected Background/Declaration form with a cover letter explaining I did mistake to fill that form 1st time, by DHL courier today. I hope it will work.

Yes, C-50 refers to the new rules. Then Pre-C-50 applications are the ones made before the new rules came into effect.
