Hi All,

I am trying to immigrate from UK to Canada and have a ongoing job search contract with a immigration company (global migrate) currently, My plan is to gain employment from someone who can provide an LMO and then apply for a TWP and move with my four dependant children. A new policy has now come into order about dependants of 19, my eldest daughter is currently 19 and will be 20 in January 2015 and my son 18, do they still apply as my dependants if we move before her birthday or do they also have to find a job? the CIC website has hardly any information on this. Also once there in Canada on the TWP can I claim for PR residency from inside Canada and what about my children?

I would also appreciate some replies on previous UK to Canada immigrators on their processes and how long it took to get there.

Thanks
Remy

1. You daughter is no longer a dependent as she has turned 19. The same for your son. note, that as you haven't applied for Permanent Resident, if he is 19, when you apply, he is also no longer a dependent.
2. They would have to qualify on their own.
3. http://www.cic.gc.ca/english/department/media/notices/2014-08-01.asp

Effective August 1, 2014, Citizenship and Immigration Canada has changed its definition of a dependent child for its immigration programs. A dependent child must be under 19 years of age, instead of the previous limit of under 22 years of age. Find out more about the change in the definition of a dependent child. New application kits, forms and fee information are now available. These new forms must be used starting August 1, 2014. Use this web tool to determine how your application may be affected.

The cut off for dependents is the 19th birthday already so your daughter has to qualify on her own. She could apply for a working holiday visa and use the opportunity to find a skilled job in order to have a chance at a closed work permit or immigration later on. If not, she could go for a study permit, take at least a 2 year degree in Canada, get a 3 year open work permit and that should be enough to qualify to immigrate if she plays her cards right. Your son will have the same issues if you don't manage to apply for PR before his 19th birthday. In that case, he'd have to qualify on his own too.
