hello, my fiancee has applied for a temporary resident visa to visit me in canada but unfortunately was rejected twice (purpose of visit, ties to home country, ties to canada, travel history, financial situation). She lived in canada before mexicans needed a visa and successfully got visa extensions and left before the final one expired - was all done legally of course. she left to return to mexico to finish her bachelors degree. so was pretty surprising that she got the trv rejected.

we have not been living together for two years now and want to live together obviously (i am a canadian citizen born and raised). so she will have completed a bachelor of arts degree and was thinking to apply for a student visa to study english at a language school here in canada. i dont know if it looks desperate to the CIC or what the chances are of it being accepted, any thoughts?
 
Her chances of being approved are on the low side given she already has two refusals. But she can certainly try.

Applying for a visa to study at a language school will certainly result in a refusal. This will look extremely desperate and CIC will see right through that.

If she wants to have any chance of being approved, she will need to apply for a visa to pursue a second Bachelor degree, a post graduate diploma or a Masters.
 
thanks for the info scylla, kind of what i didnt want to hear but expected. how about applying for english at a community college, would that change anything? because she would need to improve her english in order to go to a college/university for further schooling. is learning english and applying for a higher education an option?
 
I still think she's heading for a refusal.

Look at it from CIC's perspective:

Why is she flying all the way to Canada just to take English classes? She could certainly find classes in Mexico and save herself a substantial amount of money. It doesn't make sense unless she has another underlying motive. Add the two prior TRV refusals and this looks like a clear case of someone who is trying to get to Canada using any means possible.

I see what you mean. And then from our perspective, I have a steady job in Canada and do not want to move to Mexico for now so we would like for her to come to visit me before we get married. I mean, after we get married next year we will most likely look into more permanent plans of living together but until then is there a way for us to be together in Canada given she has had two trv refusals? we were thinking to do the student visa because it is practical, she likes canada, and we would be together - but of course fear another refusal. I am sure that could be misinterpreted as desperate, but we are in love, what's a couple to do? :(
 
She can certainly try for the student visa.

If the visa is refused, then you have the following options:

1) Visit her occasionally in Mexico until you are married and her PR visa is approved.
2) Quit your job in Canada and live in Mexico temporarily.
3) Both of you move to a third country and live there together.
 
A fourth option is to get married sooner rather than later if you are sure of your relationship. Good luck
