Hello Everyone,

I need your help guys, i am living in canada, fredericton and working as a demi chef de partie at crowne plaza. So my wife applied for trv and she got refused and the reasons are -

: Length of stay
(She applied till my visa expires which is 2017/05/28.) So should apply for only three week only, so atleast she gets a visa for six months

: employment prospects in country of residence
( She provided her pay stubs from last 3 months and offer letter. She started her job in july thats why we gave only three months pay stubs.) So should i also give leave Sanction.

: I am not satisfied that you have sufficient funds, including income or assets, to carry out your stated
purpose in going to Canada or to maintain yourself while in Canada and to effect your departure.

( We provided 8000$ in Indian bank and 2000$ Fixed Deposit, In Canadian bank i showed $15500)

So please tell what should i do now, what else i can provide. :-[

Hi Rajat,

TRV refusals were inevitable if your wife stated that she wanted to *stay* until the validity of your WP. A visitor is only supposed to visit. Even 6 months is stretching the visit to the max.

Whether she is allowed to remain for 6 months itself would depend on the immigration officer she faces at the PoE. She must apply for 2-3 weeks max. Anything longer than this means she does not have good employment ties. Ideally, she should reapply when she has a few more months of employment/payslips to show.... which would indicate her employment is stable.

With two TRV refusals, you're going to have to work very hard on the visa documentation to prove she will not overstay her 3 weeks visit.

When she reapplies:
Employment: Employment letter + leave approval letter stating she'll have her job when she returns + 6 months payslips + 2 years ITRs + a must return by date for work/personal reasons with proofs

Is this her first job? If she has worked with another employer previously, she can submit payslips + employment letter from that employer along with the current employment proofs

Other ties:
Does she own property or land? Have a leased/rented accommodation in her name? Has she enrolled for any study program on the side? Does she live with family? Does she have financial investments (FDs, RDs, shares, mutual funds, EPF/PPF, LIC, etc? Has she traveled abroad earlier?

She must draw up a day-by-day itinerary like a typical tourist of places/activities that she would like to do on her visit.

If possible (and this is NOT mandatory), she can submit round trip flight tickets to show her intention of returning home. You can buy refundable tickets which allow for date change(s).

I am not satisfied that you have sufficient funds, including income or assets
Did you have any large, last-minute deposits? Did you borrow any of the money? Does your wife's bank balance match her income?

For TRVs, the visa officer will evaluate the financial situation of your wife/whether she genuinely has the finances for her visit. Your bank statement is secondary

Cheers :)

thank you so much for your reply.

So this her first job and she started in july so we dont have any itr or six month pay slip. she can provide only july to november.

we have will on my name and wife name, we share the property but still it is will.

IMO she must wait/work for a few months before she reapplies. Right now her employment tie is not strong.

You can certainly add the will/nomination for the property. However, it will not help

so lease agreement is much stronger then will?
Yes, of course.

She can submit a copy of the lease agreement + bank statement showing rent payments + highlight the deposit forfeiture clause, if any
