One of my friend relative applied to renew her PR card in 2010 and still not received due to residency issue (someone complain about her residency to cic and now they are in doubt that if she will go and live with her husband in USA with 3 usa citizen kids (kids are with her) for good after her PR or passport)......but she has already completed her 730 days.(Not during 5 years period, after)
and she also submited application for citizenship.

Now the update is that they have closed her file........her lawyer suggest some idea to re-apply and re-open the file.

So due to her residency complain that she will not live in canada after PR card and passport. She has re-applied according to her lawyer and showed that she is alone here and she got only paper divorced from husband or she did paper marriage, (Don't know what changes they might have done? like name. date of birth). and she re-applied.

So my question is that will she get her PR? They will not ask her about her Previous application (with residency issue)...what will happen? i think this is fraud to CIC and not fair with innocent people.
 
So I assume what happened is that they refused to renew her PR card but still could not prove that she committed fraud and basically closed her file without doing anything further?

If that is the case, her application now will not be affected by the earlier application. She will now have to prove that she meets the requirements between 2007 and 2012. Thinking that she might leave after renewing her PR card can not be used as a reason to refuse her renewal, only that they do not believe she has really been living in Canada.

What kind of proof did she have for staying in Canada when she applied the first time? The best proof is having had a job. Payslips show how many hours she has worked every week and a letter from the employer stating she has worked there during whatever period would help with that too. School records of her kids would prove that they were in school in Canada. Records from the family doctor and dentist prove when they were there. Utility bills, phone bills and bank statements can help show that the family was living in Canada.

Actually she had no proof of her residency that she lived in Canada. When she got her PR card she crossed border (no record for that) after few months. And her all kids were born there and canadian doesn't have anything or medical record of kids and her duing the 4 years period, this is i'm talking about when she applied first time and someone complained about her residency. She is a housewife, never worked since she came from India.

i don't know what she wrote about her residency/proof in her first applicationand she was so sure that she will get it and also applied for citizenship. Basically she lied about her residency.

So what will happen with her 2 application? if she apply again with any different reason, will she get her PR?

Were her children born in a hospital? If so - then she should definitely be able to provide proof of that.
 
If immigration could have proven that she was lying, they could have revoked her PR but if they closed the application without doing that, she got lucky and she would be able to apply again now that she really has two years. If she doesn't actually have 2 years and is still lying, then she is being stupid trying to apply again now. If immigration didn't believe her before, they may look at her case more closely and I think she definitely needs some proof that she was living in Canada.

Ok if,she was working she can use paystubs, bank statements, credit card statements, telephone bills, she,have,kids so any visits to the hospitals above all if she apply second time then she can get records of her travel through canda border security. If she is living here for last 3yrs. So definetly she might have something.
