Hi, i came from Honduras with my family ( Wife and 3 kids) 2 years ago ( Tourist Visas) , we came running away for the violence against my wife family ( 2 of then killed by the gangs of my town ) , when we arrive to the US we went to the Buffalo border and we do the process but same day they send us back to de the US with an expulsion order by the third safe country agreement, after that i look for legal advice in US and lawyers told me 95% of the applications are denied because the flow of migrants from Mexico and Central America is very large and it was the running the election campaign and is better to wait for the results. Now we are living full of fears, the atmosphere of discrimination increases every day and even children suffer bullying in school when other children tell them that they will soon deport them.

At this moment I am desperate looking for alternatives for my family since the current US policy is anti-immigrant and anti-refuge. My question is if after being expelled by the third country agreement I can certainly appeal this decision or I can apply to another type of visa to make a new life in Canada?.

Thank you for your contributions.

What do i need for the FSW or TRV?

You won't qualify for a TRV given your status in the US. Zero chance of that and no point applying.

Detailed information about Canada's immigration programs can be found here: http://www.cic.gc.ca/english/immigrate/apply.asp

Applying for refugee / asylum is not an option for you due to the Safe Third Country Agreement.

But scylla is right

What is the difference between asylum and refugee?, So i have no options in Canada.

Basically no. You are already in a "safe" country which is the US, so you are expected to claim asylum/refugee status there.

You do have options - but you have to go through an economic immigration stream like Express Entry or the Provincial Nomination Programs.

Refugee / asylum is not an option for you.

Because you got rejected by Safe third agreement you will always be ineligible to make a refugee claim. The merits of your assylum claim doesn't matter. You can appeal to the federal court but you'll have to articulate how you should have met an exception to the safe third and how an officer made an error in assessing that or the officer wasn't fair in assessing your exception.
