I have 4 and a half months to find some way of staying in Canada. I am a UK citizen I feel like I have been a little unfortunate in my timing with regard to the CEC. I left Canada in November 2010 as my visa had expired- the CEC had not been introduced at this time. I left my boyfriend and went to Australia for 9 months grateful to be able to return to Canada in September 2011 when my CEC was accepted. I have resided in Montreal since then with my boyfriend.
On Thursday last week my application to extend my stay in accordance with the Canada Experience Visa incentive guidelines was rejected. I am ineligible as I have not been in the UK for 18 months of the last 3 years. Actually, for some reason I was considered for the Irish application, I have never lived nor been to Ireland, therefore I believe they made a mistake. However, rather than give me any information they returned the whole application untouched. Though I have complained, I do fear they will present me with the same answer if the correct processing team receives it. It seems a ridiculous rule.
The University I work for have trouble sponsoring people as it is hard to meet the requirement that their foreign worker is in a position a Canadian citizen would not want or could not do. I am not sure the spousal visa will work either as though we could evidence our relationship for 18 months we have only lived together for 9.
Any help would be gratefully appreciated. Do you think a lawyer is the only option to rush things through?
