Hello @legalfalcon,
Friend got ITA under PNP. Meet CEC as well. Declared money before ITA in profile. Now got a slot to upload pof.
Can he change it to 0 after ITA to get pof slot disappear because he meet CEC as well (but invited under PNP)? Or just leave the $ amount in profile and write loe that he meets CEC so no pof needed.
Please advise. Thanks.
You do not have to change it to 0. Even if you meet the CEC criteria, and you enter 0, you will still have the slot to upload PoF documents. IRCC clearly states:

Do I need to include proof of funds for Express Entry?
You will be asked to enter in your Express Entry profile the amount of money you will have to help you settle in Canada. This is to show that you can support yourself and any family who come with you to Canada, and helps us assess which programs you may be eligible for.
You will only need to meet the settlement fund requirement if it applies to the program you are invited to apply under.
If you are invited to apply under the Federal Skilled Worker Program or Federal Skilled Trades Program, you will need to show that you meet the settlement funds requirement unless you:
  • are currently authorized to work in Canada, and
  • have a valid job offer from an employer in Canada.
For proof, you must get official letters from any banks or financial institutions where you are keeping money.
Letter(s) must list:
  • all current bank and investment accounts
  • outstanding debts such as credit card debts and loans
Note: You do not have to meet the funds requirement if you were invited to apply under the Canadian Experience Class.
The system currently asks all applicants to provide a proof of funds document. If you don’t need to provide proof of funds, you must upload a letter explaining either that you have been invited to apply under the Canadian Experience Class, or that you have a valid job offer.

Hi @legalfalcon I have a confusion regarding my CEC application, when I initially applied for study visa and then for pgwp I did not put any foreign experience because I think that was irrelevant, but now that i have claimed points for 1 year foreign experience and 2 years of experience in canada and received an ITA and applied 3 months ago. Do you think there gonna be any problem?

Thanks

All applications filed with IRCC have to be consistent. IF they are not, then you should explain. Here is my old post on this issue:

The issue was, whether prior TRV application in which an employment detail was left out can be added to the PR application, and would this inconsistency be of any concern.
The answer is simple. If you file any application with IRCC, TRV, WP, PR etc, any of them can be looked into to review your current application and any inconsistency can be a cause of misrepresentation. All applications have to be consistent, and if they are not, a reason on why you omitted the information has to be provided.

Now I will not be deliberating that if the prior application was refused, why it should be looked into again, or you file a TRV before and you did not disclose an employment but subsequently claimed pints for it in PR and got a PPR without any issues. This is all anecdotal. Just because someone was not caught, does not make him innocent.

They law is clear, while applications for different types of status engage different considerations, it does not necessarily flow that statements made in temporary residence applications cannot affect subsequent permanent residence applications (or vice versa). In Suri v. Canada , the court found that the Officer’s concerns vis-à-vis the contradictions between the Applicants’ temporary and permanent applications were reasonable and based on that the applicant's misrepresentation ban was upheld.

Federal courts have ruled on this numerous times.

Read - Suri v. Canada available at http://canlii.ca/t/grvwt

Similarly, in the case of In Goburdhun v Canada (Citizenship and Immigration), 2013 FC 971 at para 28, Justice Strickland summarized the key considerations outlined in the jurisprudence, including the fact that paragraph 40(1)(a) is to be given a broad interpretation, capturing misrepresentations even if made by a third party such as a consultant, without the knowledge of the applicant (see also Wang v Canada (Citizenship and Immigration), 2015 FC 647 at para 25). The only exception to this rule is narrow and applies in the truly extraordinary circumstances where an applicant honestly and reasonably believed that they were not misrepresenting a material fact and knowledge of the misrepresentation was beyond the applicant’s control.

Hi @legalfalcon Thank you for the help you provide. Regarding GCMS notes, when do they start getting recorded?
1. Are the calls made to IRCC before submitting the application recorded there?
2. Are all the changes I make to the documents I upload before submitting application recorded as well?
3. Are all changes after ITA recorded?
I have replaced my uploaded documents quite a few times on the system. Is that recorded before the application submission? Are the candidates questioned on the basis of that?

1. a few days after the request is filed. At the bottom of the GCMS, you will see a date of generation. It is as on the date of generation how your application was and is captured in the GCMS notes.

1. No.

2. Not sure what your question is.

3. After your receive your ITA, your application is locked and you cannot make any changes to your profile.

As long as you do not submit your application, uploading the document and then changing then has no bearing. Only after you submit your application and pay a fee, is your application submitted.

Hi. @legalfalcon for the document question, what I meant was, that are any document changes I make to my profile recorded ? I have uploaded and replaced documents quite a few times. Will my profile be scrutinized after submission because of this? Or does it not matter what I change or replace before submitting the application? Thanks

You can make changes before you submit. As long as the changes do not impact your cRS, you need not worry.

Are you referring to the processing y the province or by IRCC after you receive the ITA.

As per the 2019 annual report, the average processing time is as follows:
(This is pre-COVID)

How long did it take to process an Express Entry application?
Table 35 displays the time, in months, that IRCC took to process 80% of applications under each program. In 2019, IRCC did not meet the processing standard of finalizing 80% of all applications sourced via Express Entry within six months. The processing time for Express Entry, overall, was eight months. As an alternative measure of processing times, 60% of applications finalized in the 12-month period ending on December 31, 2019, were completed within the six-month service standard.

Table 35: Processing Times for Express Entry applications finalized by year and immigration category, in months
Program201720182019
Canadian Experience Class457
Federal Skilled Worker469
Provincial/Territorial Nominee669
Federal Skilled Trades6712
All Programs558

Subsequent to this, IRCC also published the evaluation of Express Entry upon the completion of 5 years of express entry in May 2020. A lot of recommendation have been made in it.

Hello @legalfalcon

Our PR application is RFV as per GCMS notes BUT Minor Passport is expiring in August 2021 (9 Months from now).

1# Shall we renew Passport now or wait for couple of more months?
2# Do we still need to renew if stamping is done by Feb 2021 ( 6 months before PassPort expiry)?

Thanks & Regards

Hi @legalfalcon
I'm a FSTP applicant and currently hold Bridging open work permit and my PR application is still under process( AOR Dec 05). According to GCMS NOTES the security check not started yet.
My bridging open work permit will expire on may 2021. In worst case scenario if I don't receive the final decision before the expiration of BOWP ,what should I next? Is there is any way to extend BOWP?.
TIA

Is your Eligibility passed by an officer? It will look something like this. Most security checks are done within 1 month; longer up to 1 to 2 years if in enhanced screening.

If you can get the passport renewed now, get it done. You will get a max validity for PRV and COPR with a renewed PP, you won't have to worry about getting it renewed later and getting a passport renewed has no bearing on the processing of an application. After your get a renewed passport, send a scan of the biometric pages to IRCC via webform.
