@legalfalcon

We need your kind help in the following matter.

Our son is in canada. He first became a permanent resident through skilled category in 2009 and was in the home country outside canada from 2010 to 2017.

Since he already had a PR Status in canada, in the mid of year 2017, he got PRTD Category R-1 (H&C grounds) explaining all his circumstances under which he could not have gone back to canada all this time.

So after getting his PRTD, he immediately went back to canada to settle there permanently and is there since then.

There, he was advised by an attorney to not to apply for PR card renewal before completing his residency obligation of 2 years continuous stay in the last 5 years. So he did not apply for renewal. He is well employed there and has all the necessary documents there.

We both parents wish to visit him on family visit visa for 2 months as we have not met him in this one and a half year period. My wifeʼs visit visa was rejected twice in 2009 due to insufficient documents, funds at the time when our son was to go to canada first time in 2009 to settle there. permanently. She wanted to accompany our son

My questions are:-

  1. Can he invite parents for family visit visa on the strength of COPR and expired PR card.

  2. In our application for visit visa in the title “purpose of visit” should we make “his inability to visit us due to absence of a valid PR card and not having met the residency obligation so far” a purpose of our visit.

  3. Or should we keep our purpose of visit in the covering letter as simple as “to meet the family there” and avoid mentioning full immigration details.Does it matter in any way in our case?

We shall be extremely thankful, if you can advise us on this issue.
1. Yes. The PR is a mere proof of PR. As longas he can demonstrate that he has a job, is financially sufficient, and has been in Canada for the last few years, there should be no problem. Along with the COPR, he should also include his bank account statements, letter from the employer, lease document, driver's license and any other documents documenting his ties to Canada.

2. No, simply mention that you want to visit your child. Also get a letter of invitation from your son.

3. see above. Keep it simple, and do not complicate your case. Also, your son is eligible for a PR card. A PRTD was issued to him because he is a PR.

Hi @legalfalcon

I would very much appreciate your thoughts and input related to my spouse's financial statements.

I am the main applicant and my husband is accompanying me to Canada. My proof of funds is tied entirely to my own accounts and I will be providing my financial statements for those. I don't have any debt or loans in my name.

My question is: as my husband is accompanying me however, is there any need to declare his financial statements and/or debts?

Thank you in advance!
No. There is no need to show your husband's financial accounts. The PA has to meet the PoF requirement. The PA can show the funds in his/her account, in a joint account or any other similar means.

My application was recently transferred to RomaVO on dec.21/18 and rec'd processing notification on Jan.3/19. I heard Roma has longer time frames.

Thanks,

Fafa
What is your question?

Hi legalfalcon,

You are a great help to many people here and I thank you!

I have a question, I read in this thread that if one is employed by the government (governmental affiliation.) I worked for the city and currently employed by the Federal gov. (public service), does that mean my application will be subject to longer PROCESSING TIMEFRAME?

Many Thanks,
Fafa
Just because you were employed by the government does not mean that you will go through enhanced security screening. It is the nature of the job. Whether you were a part of intelligence gathering, highly skilled explosive expert etc. are things that may land an applicant in enhanced security screening. Also, the country you come from, the political stability in the country, the availability of information from your country and many other factors will determine if an applicant will be subjected to enhanced SS.

Hi @legalfalcon
Inland, FSW, AOR Sep 5, ADR for Canadian PCC Sep 27th, submitted after a few days. Still waiting for PPR. More details in my signature.

I called CIC yesterday, eligibility in progress, criminality not started and security passed. I don’t know why they haven’t started with criminality. Any idea why?
Would you be able to say roughly how much more time before PPR?

My application is in Ottawa.

Thanks
For inland applicants criminality take place later, when IRCC requests RCMP PCC.

@legalfalcon I am working for the same employer, in a different country.
My Eligibility is MET according to GCMS notes.

Is raising multiple CSE's fine. ( already raised one about change of address two days back).
Is this kind of major mistake which can effect my application ?
You can raise multiple CSEs based on what info you are providing. Even if you do not provide the change of employment country, it will not matter as your eligibility is met. But better to do it.

Thank you so much for reply..

Regarding point-3, I read that blog on the link provided below. Just a couple of queries regarding the same:

1. If I get married in near future, there can be 2 scenarios;

(a) If wife isn't accompanying & my CRS score is above the cut off at that time after change in marital status, is it enough to inform IRCC about the change in marital status? do I need to submit any document? And will that delay the process?

(b) If wife is accompanying & combined score is above the cut off, I think we will need to add her WES, PCC, marriage certificate and all other relevant docs along with updated proof of funds. Is it right? In that case, it will require additional 4-5 months after submitting all the documents. Is this correct as well? Can you please share details, if you have, around this?

In case of (a) you only have to inform IRCC and submit your spouse's PCC, passport and meds. You will also have to submit your marriage certificate. All members mention in the application have to be admissible to Canada on medical, criminality, irrespective of whether they are accompanying or not.

As regards (b) You will have to file the above mentioned documents, and in addition, also file the following:

An IMM8 Application form including your spouse details.
- Schedule A form for your spouse
- Additional Family Information form for you and your spouse.
- Processing fee for your spouse
- RPRF (Landing fee) for you and your spouse
- Notarized copy of the birth certificate of your spouse
- A few wedding photographs
- Police clearance certificates for you and your spouse and PCCs for any other country in which the spouse has resided in for 6 months or more since turning 18

Usually IRCC does not award points for education from unrecognized university. If you want to claim points for the diploma, try getting an ECA from another agency and see if they recognize the university that granted the diploma.
Hi sir,

thank you very much for your valuable piece of advice and information.

Kindly guide whether I should order GCMS notes or shall i upload docs via CSE (webform) anticipatingan ADR?

Also, my PCC will expire on 24th March 2019, so shall I now upload fresh ones via CSE (webform), kindly suggest??
