My cousin plans on lodging their application in this month under Nova Scotia PNP.

Her spouse does not have Canadian experience or Canadian Education.
Does he need to provide his Masters degree from Pakistan? If he mentions the Masters in the Education section, it generates a placeholder at the checklist asking for his Masters degree.

Any need to do this, or can he simply say he does not have any education in the education part and only mention it in the Personal History part?
For spouse, you get points for education given that you have ECA. If you do not want to get ECA done, you can ignore it and just say no.

Hi @legalfalcon

When I open my application and open the application part when the ITA was recieved ( below permanent residency application) , the score there was 388 points ... how come my points go down ? when I recieved my ITA it was 442 and I got invitation.. There's nothing changed in my profile..

Ielts still one more year valid, canadian experience very recent 2016 march to 2017 march , Age I'm still 28
there is nothing that could change my points .. is that what causing the delay in my eligibility ??

I have GCMS notes and there as well I see in one of the places that it was 388..

but in the notes by officer it was clearly mentioned that points 442, ITA score 441, met all requirements..

this could be a system glitch or I do not have to worry at all even the points drop or do not drop since I'm invited when I had that points..

I'm emphasizing again, there is no way my points would drop.. Single, 28, more than 1 years ielts valid, recent job and everything is there... Can you throw some light on this ??? is this the reason why application stuck at eligibility N/A for the last 4 months though GCMS notes says recommend pass ??
Based on what you state, it sure looks like a system issue, but wait for the GCMS, they will show you the exact picture.

Sorry for this inconvenience.

Just to brief you in nutshell, I am returning worker from Canada, I was on closed work permit from 2013 to 2015. During that period there was a Moratorium on TFW so me and two of my friends (he is my current employer now) decided to start a business, and we got Mac's convenience store franchise in Ontario.

As I was on closed work permit, and got (wrong)advised by ICCRC member to apply open work permit under LMIA exemption under owner operator as I was holding some share in that Incorporation. We did apply but unfortunately that was rejected and CIC put allegation of non compliance under subsection s44. I did clear this but at the end I need to come back to my home county. when I came back, I had to remove my name from this incorporation including my shares.

Meanwhile from that same incorporation(company), we had applied store supervisor LMIA for me and eventually that was approved. I applied work permit outland application but that was rejected due to lack of skilled work experience.

Now the question is --> 1)That same employer is willing to support me for my permanent residency and he is ready to provide me supervisor LMIA as I got 2 and half year skilled work experience with same job category. Additionally this is my third time application with him.

2) Should I accept this and go ahead with PR application?? reason I m worried because His name and company's name already in my GCMS notes.

3) Would IRCC accept this repetitively application with same employer?

I got GCMS notes and they haven't written anything about employer. It was my lack of work experience which cause refusal in previous application.

Please clear this confusion as I am really worried for this and its getting bigger and bigger in my mind.

There should be no problem as long as you meet all the criteria. You will have to explain the last rejection in LoE.

Hi @legalfalcon,

I'm in IP2 since Sep 22... Last time i called CIC (Sep 25th) they said I passed criminality and eligibility and they were doing security so... any ideas when to expect a PPR ?
Security is a tricky part. If you get stuck in Security screening, it can take months. So to be sure, you should consider ordering GCMS notes and see what is going on.

Hey Legal Falcon,

I have a small query..I have a july e-aor and file is already in status NA2.
As per my consultant, file is being processed in NDVO. He ordered gcms notes and those stated that the file was transferred to NDVO on 15 sep.

Now the problem is with my current Job.
Off-late things are not going well and I was thinking of leaving my job.
My POF is already secured in a separate account and I have decent savings to last for next few months in economical way.

My only concern is if I leave my job which was shown as current during file submission, Is there going to be any adverse
effect on my application?

Shall I raise a CSE which as per my understanding might add time to processing of my file ?

thanks in advance.
The application is locked on the date when you file the application. Any changes after the filing date do not impact your application at all.

I ordered GCMS on the 10th, I'm just wondering how long does it take to get from IP2 to PPR, some are saying 3 weeks, others up to 5 weeks.. Any idea?

IP, NA etc are just speculation, the question is whether you have cleared eligibility. Every application is different. You can see the trends, but to be sure you need GCMS notes so that you know what stage you are at.

Based on what you state, it sure looks like a system issue, but wait for the GCMS, they will show you the exact picture.
And on the 2nd and 3rd notes section by case analyst and program assistant on June 7th they mentioned : verified ECA from the institution states Canadian equivalency of 4 years bachelors , documents verified and I recommend pass !! there was no mention of points drop by case analyst and program assistant .. they said everything met including A11.2 and R87.1 etc

But on the assessments 1 : which was generated on may 4th ( day if my AOR ) mentioned that I have 388 points with highest degree post graduate diploma in Canada .. but I have mentioned and submit my WES and degree certificate as well !! That is why the program assistant and case analyst had mentioned about ECAs and no mention of any red flag ..

Do you think it's better to pro active and raise a CSR and tell them that I've submitted my ECA and why there's decrease in score ? And also can I mention that it was mentioned in case analyst notes as well in GCMS notes that they've my ECA which was verified successfully ??

Hi @legalfalcon I need your advice, I got an email from cic that they have started processing my background and needs some document, below is the exact wording:

"Court record / Police report: Provide an original police report or court records. Please provide an explanation of the events surrounding the charge indicated on your RCMP Clearance. Also, please submit all police reports and court records associated to this charge. This must be received at this office by: 2017/10/18"

The charges were withdrawn and RCMP indicates the same thing. We have managed to get the court record from the respective court with their attestation/certified stamp on it. We tried to speak to the local police and they said the police report will take 30 days for processing. We anyhow have sent the draft and mailed the form they need for the process. I have 2 concerns here, based on the above wording do you think just court record/ court order will suffice or we need to get an extension so that we can submit the police report as well.

Please advice

As soon as you get your PP, raise a CSE and update your passport and only then send the new one.
@legalfalcon
Just to let you know, I decided to send both of my passports to be on the safer side. I received them back yesterday along with the COPR. No issues at all.
My sincere thanks to you for all the counsel you provided. I would love to treat you to couple of beers to express my gratitude. Hit me up if it interests you. Thank you and keep up the good work. Cheers.
