My PR application has been approved on 02 April 2019 and I received my passport back with single-entry immigrant visa which is valid by 04 Mar 2020. I received my medical certificate on 26 April 2018 and technically it should be valid by 26 April 2019 (according to CIC website and common practice).

The expiry date of my immigrant visa is almost 11 months longer than the validity of my medical certificate which I believe is uncommon.

In this case, I would like to understand:

- Is it 100% certain that the medical exam is valid for 1 year or are there any exceptions to this?
- If I enter Canada after 26 April 2019 and within the validity of my visa, should I renew the medical exam?

The "Medical Details" section on my COPR document, the validity is mentioned as 04 Mar 2020 but I am still confused because on this web page the validity period of the medical certificate is defined as 12 months.

The validity of the medical examination is one year. However, at the discretion of the VO it can be extended, which is what happened in your case.

The request is sent to CBSA and CSIS together. After CSIS concludes its report, the report is sent to CBSA, which will then conclude its findings and send both the reports to IRCC.
would you recommend i order CSIS notes to check if they have processed my file and sent their findings to CBSA?

You will have to request both, CBSA and CSIS to know if each agency has finished their involvement in your application.

The PS review is Ministry for Public Safety, who will review your case and provide a recommendation. It will depend on whether the offence you were charged with makes you criminally inadmissible in Canada.

If your application is approved and the VO realizes that your meds have expired or are about to expire or about to, they can in their own discretion extend it. This is why you have been given a longer visa.

Many thanks @legalfalcon for your kind reply. On raising CSE on 26th March, I got a reply from IRCC stating that " The Background Verification's are currently in process"
BGC is security and criminality and info sharing all together.

Hi @legalfalcon . My aor27 Jan 2019. Medical clear .bio complete and Adr 5669imm was required . I have one doubt. There 1 question was whether u faced any refusal. ..... in 2009 my mom applied for canada pr and me n my bro was dependent. It got refused . But while filling I didn't mentioned it because I had no file number etc. I got married in 2013 and had no knowledge of any refusal letter.. I am so worried. Will it be misrepresentation from my side? Pls help

First of just because you see someone's status on the forum as "VIP," "Hero." etc. has no relevance. This is purely based on number of comments you have posted.

As regards your questions, as a minor, you cannot sign or file any documents and therefore legally, you do not act on your own behalf. Further, an immigration application is for the primary applicant and not the dependents. Your parents immigration application, which was refused will have no bearing on your application and you did the right thing by answering no.

However, if you have doubts you can send a CSE and clarify that you were a part of an immigration application filed by your parents in [YEAR] which was refused.

Irrespective of whether you inform IRCC or not, it doesn't matter.

The statutory questions are asked to do a BGC and are also used for misrepresentation. Section 40 of the IRPA defines "misrepresentation" as:

40. (1) A permanent resident or a foreign national is inadmissible for misrepresentation
(a) for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;
(b) for being or having been sponsored by a person who is determined to be inadmissible for misrepresentation;
(c) on a final determination to vacate a decision to allow their claim for refugee protection or application for protection; or
o(d) on ceasing to be a citizen under paragraph 10(1)(a) of the Citizenship Act, in the circumstances set out in subsection 10(2) of that Act.
Further s. 127 states:

127. No person shall knowingly
(a) directly or indirectly misrepresent or withhold material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;
(b) communicate, directly or indirectly, by any means, false or misleading information or declarations with intent to induce or deter immigration to Canada; or
(c) refuse to be sworn or to affirm or declare, as the case may be, or to answer a question put to the person at an examination or at a proceeding held under this Act
Now the question revolves around, Materiality & Relevancy

Just because if a question is answered incorrectly, of falsely or with incomplete information, it doesn’t mean that misrepresentation will or can result in a problem. That depends on whether the information was “material” and “relating to a relevant matter that induces or could induce an error in the administration of this Act.” To be material, a misrepresentation need not be decisive or determinative but it will be material if it is important enough to affect the process.

Failure to Disclose

Innocent misrepresentations include statements that are not accurate. More problematic are those cases where, although not asked, one fails to disclose information that which is relevant and material.

The leading case on this area is Brooks [1974] S.C.R. 850

In your case, failure to disclose is immaterial, but since you are aware of it, you should inform IRCC even though it will not matter in making a decision on your application.

If Intra Company Transfer work permit is applied as GATS: Intra-Company Transferee – Senior Manager for position Computer and Information Systems Manager (NOC: 0213) (LMIA exempt) and get approved, would it qualify the employee for 50 points (Job Offer Express Entry) after one year on work permit in Canada assuming he can provide required documents like offer letter etc?

Above link states ICT with specialized knowledge will be considered for LMIA exempt job offer points. Thats why I have this doubt.

Hi @legalfalcon. I recently ordered my gcms notes. I received my e-AoR in August 2018. Here are the relevant points from the notes:

1. EE, FSW Eligibility met, security and criminality not started, medicals passed
2. The office was changed to CPC-Ottawa from Centralized Intake Office on account of workload redistribution
3. The last note says PREvU verified which was on 9th October, 2018

Would be great if you could help me understand if it's normal to have a 6 month delay in such a case where eligibility has been met. Also what are the options available in this case to understand what is holding up a PPR aside from GCMS notes? I am slightly anxious as the GCMS notes have not helped me with an explanation per se for the delay. Thanks a ton in advance for the help.
