Hi All, looking for suggestions.

I have completed my 1 year diploma in montreal. Got 1year pgwp and it has got expired this Jan. I have applied for work permit extension through immigration Lawyer and it is currently in implied status.

I am looking to travel india for my marriage. Should I apply for study permit or visitor visa ? I want to make sure that I have option back to Canada

Visitor Visa: So that I can process my wife for study permit and later go for spouse open work permit.

Study permit: So that I have valid visa to come back.

Need your suggestions as to which is the best option for me to go?
 
Maybe clarify what you mean by work permit extension given a PGWP cannnot be extended unless it was issued short due to passport expiry .Are you saying your PGWP expired 1/2020 ? Are you still working ? Why do you think you have some sort of implied status , for what basis ?

If you leave the country then obviously you would need a valid TRV to travel back regardless

Thanks for replying I am not allowed to work legally I have some sort of status which could remain in country. Yes I mentioned work permit but ultimately it will not extend if ircc makes decision also because I consulted with my consultant has said it could keep you stay in your country but not allowed to travel and not allowed to work legally. As my consultant is looking for a employer to apply for LMIA but he kept status only implied which I can remain in country as for now it has been 5.5 months due to pandemic the file has not processed and the processing times are very slow also if results in refusal can apply for one more status to keep me extended on implied. But my marriage is getting fixed soon and I am looking to have a formidable status to keep and return to canada. Hence what will be suitable options is it visitor visa or student visa.

This sounds pretty dodgy. An LMIA is needed before applying for a work permit, and you should find your own employer willing to go through the process, not have a consultant do it. Some have been known to trade in fake jobs and fraudulent applications.

Keep in mind you can't receive another PGWP by studying again, and if they think you're applying for a study permit just to get status for you or your wife, they'll refuse your application. I would have not relied on any of the consultants and while my work permit was getting expired i tried convincing my employer to support my LMIA but unfortunately my employer refused i have to quit the work I tried all my options but I regret of getting trapped my consultant initially responded me and approached a employer it wasn't good venture for me and my consultant he didn't offer to support LMIA just because I haven't had sufficient experience then later it resulted into big wait. I had to wait for 5 months and still counting but now I am thinking to go home and get marry and come back and end the term with consultant as he got the employer but it is still time consuming till wait for more 6 months i had my nerves now as i am not legal to work my time is not worth to wait and I need to look in to other options also thats why I plan to get marry but I am struck with this implied status with no valid visa of returning to Canada i am figuring out in study visa or a visitor visa

Eventually you will have to return home if you don't successfully acquire a new legal status in Canada. You could already be out of status. At that point you would have to apply for a new visa to return to Canada like anyone else.

Sounds like they are just using you for your money. Consultants are not lawyers, and if they are guaranteeing an LMIA, they are lying. The best thing you can do is go back to your home country as apply for Express Entry. Chances of you getting a visitor or another student visa are low
 
If you leave Canada you are going to lose your implied status. Still confused as to what your consultant apllied for. You should really find out what you have applied for. If you leave Canada you likely won't be able to reenter. A bit hard at the moment but you really need to try an enployer willing to apply for an LMIA and if they get approved you need to apply for a WPm This is not a shiort process. It can take 4-6 months in normal times. With rhe delaya due to covid and the high unemployment rate getting an LMIA and work permit will take longer and be harder to secure. What did you study? What type of work experience do you have? For in denand skills like IT LMIAs may still be posssible.
