Hi all.

I am currently separated from my spouse. I came here as a companion person with an open work permit. We are still legally joined. We decided not to notify the IRCC of the separation because we are afraid that I would be forced to leave Canada once they know we are no longer partners.

I have several questions regarding my current situation:

1- Are we obligated to inform the IRCC of this situation?
2- if we don't, would it affect my ex-partner in the case of applying for a post-graduation work permit?
3-What are the probabilities to get permanent residence on my own after having an open work permit?

I hope this makes sense for someone.

Temporal residence with study permit

You will have to inform IRCC of your separation when he applies for PGWP or a study permit extension. You would not qualify for any extension or new SOWP. If you fail to inform IRCC there could be serious consequences with current permits/visas and permanent residency and citizenship applications for the both of you.

That sounds like very bad news for me. What if I manage to get a full time contract? is it possible to request a new work permit?.. I mean, it is obvious that my ex-partner is not gonna include me in the PGWP papers... Did I run out of options here?

If you want to keep working past the expiry of your OWP, your employer needs to obtain an approved LMIA so that you can switch to a closed work permit.

There might be other options but we don't have much info about you so hard to tell.

Where are you from and how old are you?

Have you checked out how many points you might have under the Express Entry immigration program?

I roughly have 743 points with the calculator. However, I have still 2 years ahead with my OWP and I have the chances to increase it.

743 points is extremely high. You must be calculating something incorrectly.

Please post any further questions to the forum. If you're looking for private advice, then your best bet is to hire a lawyer to assist you.

Why extremely high?
Maybe because I added the language skills without even have the language certification. That was a guess. My mother tongue is nor english neither french, So I put approximately scores for IELST.

I have so far 1-year of experience working in Canada. I have a bachelor's diploma from my home country and 3+ years of experience in the professional field. I currently live in the province of Quebec, so I suppose that I would also need to prove some French proficiency

Most scores are around 400. 468 or more if you are fluent in both languages and have a PhD. So there is no way you have 743. If you live in Quebec, they have their own immigration program.

Would warn you than many employers are not willing to apply for LMIA do to the time and cost. LMIA approval and WP approval are not guaranteed especially give the amount of people in Canada who are unemployed. Hopefully you have skills that are in demand in Canada. What field are you in?

My major is related to forest management. I still do not have professional experience in the field here in Canada.

Don't believe forest management jobs are in high demand. If you had been in a field like IT and LMIA would likely be much easier.

I think you are assuming that you will get PNP or something without applying. Usually its hard to go pass 600. Please use canada.ca crs calculator.

If you indeed have these many you will be among top 300 people in a cohort of 200,000 - 300,000 aspirants. That way, if your points are indeed as much, you are guarenteed to get an invite whenever you apply.

Be careful, if job is regulated in Canada. There are lots of local mafia professional societies which regulate certain jobs. I do not know if this job is regulated that way or not. Check for it. My wife who is a chemical engineer had a lot of trouble because she could not call herself "Chemical Engineer" due to EGBC mafia professional societies. That makes entire LMIA totally infeasible.
