Hello everyone!

I'm applying for spousal sponsorship. I (Canadian) am sponsoring my husband (US) who lives in the US right now.

I remember reading that once we send in our initial application, the sponsored can pass the border with the receipt (IMM 5401) and he would receive a visitor's permit without any problems. Is this true?

Also some background on our past experiences with the border:
- Last year, he lived with me from May to October, with much trouble from the border (visitor's record, not allowing 6 months, must leave at a certain date, etc). We tried entering twice, the first time they turned us around due to "lack of ties to the US". :'(
- When he left in October, the border told us that he should "stay in the US for a while before returning". Just verbally, nothing written, but I think it is on his record if he returns? How long would this "a while" be?
- We were not married back then, but we are now (December).

So my question is that would he be able to come here as a visitor while our application is processing? Last year we drove through the border, this time he'll be flying in, if that makes a difference. We're terribly afraid that he'll get stuck at the border again (not a good feeling!).

Thanks in advance!

Hi
I am an Irish Citizen, married to a Canadian.
We have our Inland Application lodged since June 2011
I just returned from a 2 week vacation in Ireland
When I got to the border they sent me to immigration
She was very friendly. Looked up my file and said she could see I had a PR application, sponsorship and open work permit.
I got a visitor record until Dec 2013 !
All done in less than 10 minutes.
I have heard some horror stories of people being turned back
Maybe the fact that I had my 6 month old with me helped, I honestly don't know.

I put some questions on this site before I left Canada and the general opinion was DON'T leave but I needed to see my unwell Dad.

Good luck in whatever you decide.

irishred - Thanks for the reply! I'm glad to hear that the border isn't always so tough on people, heh. That definitely gives me a little hope, but I'm still a little unsure (as always).

Don't sneak around. Be dead honest. DON'T APPLY INLAND. Submit an outland application to Buffalo.

1. Pay the application fee
2. Submit your application.
3. Wait until you are approved as a sponsor (You can try to get in before, but its risky)
4. Show that you have enough money to live together in Canada.
5. Arrive at the border together and tell the truth. You want to live together while the applicaiton is being processed.
