Hi,

I have a non-accompanying common-law partner who is already a PR. As I went through the checklist of EE, I saw there *looks like* lots of supporting docs needed for common-law partner.

As I am not including my common-law partner as part of my application, I am wondering if I still need to provide the following docs.

1. police certificate.
2. proof of studies
3. digital photo
4. other name
5. pr card
6. passport
7. medical exam


And also do I need to provide the following even when she isn't accompanying?

8. evidence of common-law
9. proof of a relationship to a relative in Canada

Upload a letter of explanation that your CLP is already a permanent resident, along with a scan of the PR card.


And also do I need to provide the following even when she isn't accompanying?

If you gained points based on your relationship, then yes, you need to document it.
 
Hi, just saw this while trying to find the answer to my question. I see this is an old forum but are you able to give me insight as to how you ended up doing your application?

I’m in the same boat, except that my common law spouse is not PR In Canada and I would like to sponsor her once I receive my PR. The reason we didn’t do a joint application is because my points were higher alone. I have recieved my ITA and declared my common law spouse as non-accompanying. Do I need to provide police clearance etc for her if she is non-accompanying?

Yes, you need to provide PCCs and everything else even though she is non-accompanying.

One other question, when it comes to the fund requirements, if I am the principal applicant and my girlfriend is the non-accompanying common law partner on my application. Does it count as 1 person or 2 people for the fund requirements?

You must have enough funds for 2 people.
 
Do you mind linking the information where you see this? Don’t really understand the need for funding requirements for 2 people if only one person is moving over

This is a pretty basic and very well known rule. The logic is easy to explain. IRCC wants to make sure you have sufficient funds to cover your entire family's settlement in Canada. The rule to include all dependents exists to make sure people don't list a spouse or children as non accompanying simply because they don't have the funds - and then immediately sponsor them through family class PR once they have PR themselves and are in Canada.

You've already indicated in a previous post that you plan to sponsor her as soon as you have PR. So this is a perfect example of exactly this situation.
