Supervisa

Good Evening,

I just need some advice from people in a similar situation.

After nearly 10 years of pestering, threats and walkouts by my wife I finally relented to giving my inlaws in India a Supervisa. But I should have known better and trusted by gut instinct.

As soon as they arrived they started pressuring me for a PR card but initially it was "we just want to visit" literally they wake up 6am in the morning and wait downstairs for me to wakeup and before I leave for work make threats like " divorce could be an option" so this led to a major fight several weeks ago as my wife was joining them.

The result was my wife took my small child along with her parents to their relatives home and stayed there for a few days.

They are taking a toll on my physical and mental health. I pay nearly 4500 dollars a month in mortgage, heating, electricity, car payments and my wifes contribution despite making 50,000 a year is about 150 dollars a month. So I asked her about it and the result was being shouted down by all 3 in my own home with threats of everything being taken away.

I have asked them to leave and got older relatives to do it as well without luck so far. My fear is that this eventually going to lead to something major involving police.

Their Supervisa lasts until May 2018 and I don't know if anything can be done. I feel like withdrawing my sponsorship when they leave but don't know how or if I can.

You can't withdraw sponsorship and cannot force them to leave Canada.

In terms of leaving your home - this isn't an immigration matter. Engaging the police as required is probably the right move.

Ok, I'm confused. When their visa expires in May 2018 they have to return to their home country for a period of two years, right? So, when they decide to return don't I have to resubmit updated documents - job letter, notice of assessment?

When their visa expires in May 2018 - then either need to return to their home country or they need to apply for an extension to their visit from within Canada before the visa expires (whether that extension is approved or not is up to CIC). If the extension is approved, it will allow them to remain in Canada longer - although they will eventually have to leave.

Once they leave after their visa expires, they would need to apply for a brand new super visa again from scratch (including providing a NOA, job letter, all of the forms, medical, insurance, etc.).
