Hi everyone, I am hoping I can get some advice on what options I now have left in my situation.
I came to CA on a IEC 2year working holiday permit from the uk
My partner is a PR of Canada and we have been in a common law relationship as of May 2018
I applied for common law PR around 3 mths before my work permit expired, we had to leave it to this late point before applying due to some financial constraints at the time. Unfortunately my PR application got returned a week or 2 after my working holiday permit expired due to not providing a most recent copy of my partners tax NOA
As soon as we had gathered the correct documentation we reposted the application for PR as well as owp app and app to request restoration of status (I overworked my iec work permit by a few days by thinking I was covered by an implied status until my PR was processed.)
I received an email notification that my PR had been received and I then managed to link the PR app to my online profile. I have now been requested to have a medical completed which I will have at the end of this week.
I unfortunately have been sent back my OWP application due to a very basic error ( typo in date signature box) and have also been sent a letter stating that the entire package be resent to Edmonton.
I have now resubmitted the OWP with the date corrected by post yesterday.
Although, I now have a few worries after doing so
I did not submit a new declaration of common law union as the one I previously submitted (and which is only 2mths old ) was not returned to me. The only docs in the packet that CIC returned were the incorrectly completed OWP (imm5710) and the document checklist, as well as the letter saying I need to resubmit a correctly signed OWP app to Edmonton and my fee’s receipt which had my uci handwritten on it. I called the CIC helpline to get some more advice on what to send back as I was surprised the declaration hadn’t also been returned and after 30mins on hold I got through to a worker who advised me that I can include a cover letter to say they already have my declaration of common law union so do not need to resubmit that - I am just worried this was bad information and that I should in fact have got a new declaration notarised. Will this most likely end up with my owp app being returned again. To my mind it would have made sense for CIC to return the declaration along with the incorrect form they returned if they required me to resubmit it as it would still be a valid document for resubmission.
Another worry is that it has now been more than 90 days since my visa expired and I am now out of status - will this affect the processing of my PR app and resubmitted OWP app ? Am I legally able to remain in Canada until a decision is made on the PR app?
I had some advice from an immigration lawyer who said that as I am now out of status I should go to the US and return in order to refresh my visitor status. I am not overly keen on this as do not want to potentially be stranded in the US if they deny me re-entry.
If anyone has dealt with a similar situation or has any advice that they may be able to provide I would really appreciate it.
