Hi
My Family of three landed on March 12, 2016. My wife got sick after being one year in Canada after landing. She went back home and stayed there never returned. My daughter and I frequently visited her and came back to Canada to maintain 730 days. Two of us (Daughter and I) 730 obligation days are going to be met on Feb 26, 2021 (Landed on March 12, 2016)
my concerns are
1, does my wife's non-compliance affect our renewal?
2. Can I leave Canada before the new PR card arrives and have friends to send those PR cards back home?
I am kind of rushing situation because my other family members (3) are COVID 19/pneumonia patients and need more care back home. Two of them ( over 75 years old) got hospitalized for 1 month. Still in different Covid 19 related problems.
Just arrived in Canada 17(14 days in quarantine) days ago to apply for PR renewal.

1. No impact.
2. Yes, you can do that. Note that PR card processing times are quite long right now so you may have to apply for a PRTD to return. Make sure you are absolutely sure you have the 730 days at the time you apply. Preferably you should have more than 730 in case you've made any calculation errors.

Thank you Scylla,

Can I use the renewed PR card that I will receive through my friend back home to return to Canada? I think I will stay back home for more than 8 months.

Yes, just make sure you continue to meet the residency requirement.

Will you continue to meet your RO if you leave for 8 months? It becomes a rolling total so you'll need to meet the 730 days out of 5 years on any day. You can be asked to submit more information of pick up your card in person if there are concerns about your compliance.

I confused while filling the application for PR card renewal. The confusion is :
1. The day I departure from canada . Do I count it as physically present here? For example : flew from Toronto to Dubai on 27 feb at 2 pm. Am I in Canada to account a day?
2. arrived in Canada from Dubai at 2pm on 3 March ,on this March 3 , am I physically present?

Even if you are present on Canadian soil for a minute of that day, you can count it as physically present. So, both 27th Feb and 3rd March count as present in Canada.

On another note, I would suggest to add a few days of buffer in RO when submitting the application. So, try to have 750 days in Canada instead of 730 days when you sign your application.

Am I correct?
I landed on March 12, 2016, that means my five years completion will be on March 11, 2021. My understanding is from March 12, 2021, it resets to new five years window. Is it correct?

Also just making sure, the signing day does not count as physical presence, does it?

I am not sure, I didnt count it when signing for my PR renewal. These issues won't matter if you have enough buffer

No, it's a rolling window, not a reset. Which means you need to be physically present in Canada 2 out of 5 years from the date of your every interaction with IRCC after 12 March 2021 (at border or application submission).

Ok thank you.
That means if I submit my application on March 3,2021, that will be my interaction with cic, and that point of time will open for next five years .

Date of application for a new PR card is NOT relevant, NOT at all relevant, for purposes of assessing Residency Obligation compliance on any future date. So it has NOTHING to do with six months into the future, let alone years.

Example: date of application for new PR card is March 3, 2021, and a new card is issued May 19, 2021, which will expire May 18, 2026. If this PR is arriving at a Canadian PoE, returning to Canada, December 21, 2021, and shows the border officials the new card which does not expire until May 18, 2026, the PR can still be examined regarding RO compliance. If so, that examination will be focused on whether the PR was IN Canada at least 730 days between December 21, 2016 and that day, December 21, 2021.

If that PR is examined at a PoE July 17, 2022, for purposes of complying with the RO the PR will need to show being IN Canada at least 730 days between July 17, 2017 and July 17, 2022.

Date the PR card application was made is NOT relevant. Date the new PR card expires is NOT relevant.

Date of application for a new PR card is only relevant for the purpose of evaluating whether or not the PR is eligible to be issued a new PR card. The PR should be in compliance with the RO on the date the application is made.
