Submit Application (pending police checks)

Hi, did anyone apply for PR by sending the application (without all police checks) ? I have lived in a few countries in the last 19 years, including the US. the FBI clearance from US takes around 2 months i have heard, as compared to the other places i have lived (around 10 days) I am thinking about sending it all i have, i mean i have all completed, forms, medical, and most police checks. Anyone done this? and later completed? or should i just wait until i get the FBI check back and submit all at once?

ultimate goal, obviously, is to get the PR as soon as possible

You should try to send all at once, if you're missing a document, they will request it, but not before sending your application to the bottom of the pile collecting dust for 6 months.

I've read you should send it in without the police checks in this case.

Most people are not aware that you can send criminal record checks later in the process if you wish.

If your application is ready to submit and you find out it will take weeks (or months) for your criminal record checks to arrive, submit your application to get into the queue and submit your criminal record checks later, ideally when CIC requests them so they do not get lost.

My wife and I could have saved months if we'd known this, as we were juggling several police certificates with cascading expiry dates.

Ideally that is what i would like to do, but at the same time i don't want to be put back in the queue for incomplete applications!

Sorry about that. I hope there's nothing wrong with it. To me, it's a professional looking website (except for one glaring spelling mistake).

Perhaps Google "spousor your spouse for Canadian permanent residence" (sic) and then click on the Google cache.

No problem, definitively something wrong with that website though. Both my home antivirus (ESET5) and work (Norton) rejects it. Anyways, i think the point is that i should wait for all documents to arrive before sending it in.

With respect to police certificates, that's not what the webpage says. It was written by an immigration lawyer.

thank you, where do you see that on the immigration website? I have been trying to find anything that suggest you can apply, then compliment the application (police checks) at a later date. US police checks are currently 4-6 months which is crazy, specially when everything else about my application is ready.

That's not entirely true, and it's unfortunate for people who are waiting for police checks.

CIC can't legally refuse to process an application if it meets the "minimum requirements for an application." These are defined in the regulations, but are explained in Section 5.13 and following of CIC Manual IP 2.

5.13. Minimum requirements for applications

R10 describes an application including minimum information and documents required
to accept an application.

Table 11: Minimum requirements for an application for permanent residence

IMM 0008EGEN signed by the applicant
Must be preceded or accompanied by a sponsorship application as prescribed in R10(4)
Information prescribed in R10(1) and (2) of the Regulations
If a representative is retained, a completed “Use of a Representative” form (IMM 5476)
Evidence of payment of applicable fees

I'm basing this on what the immigration lawyer writes - he looks authoritative to me - and my reading of the portions of IP 2 that deal with "minimal requirements" for an application.

I never knew that, I always thought you're supposed to send in your sponsorship and PR at the same time.

Never had much success in trying to reach CIC via phone here from Hong Kong, so i made a trip to the Canadian consulate yesterday. A three floor office, where i was first sent to 14th floor, then 13th, then to the 12th. On top of that, at the 12th floor i was told to visit the local VAC instead (visa processing office in Hong Kong) However, the VAC told me they only process and wouldn't be able to answer my question. Did tell me though to go back to the consulate, and insist to speak to some one.

Will do that Monday 9th September, and post my findings here as i saw some other threads about the same question.

There was a thread somewhere about someone who submitted the whole PR application, without the FBI check, and everything was smooth, CIC never even requested the FBI check to be sent in once received. I'm guessing that's more the exception than the rule. I think it's more likely they'll want it than not.

We sent our app in without having done a medical exam, and without my police certificate. We sent those in later, before CIC requested them, and our process was not delayed.

We sent in just the sponsorship portion of the app (when you start reading through the Québec stuff, it's pretty easy to get confused) in August of 2012 without the PR portion of the app. I hadn't found this forum yet, and we thought that was how you applied from within Québec. I received a call from a woman at CIC stating that my app was incomplete and telling me to submit the rest of it. She provided a mailing address and a name for the person to whose attention we should mail the rest of the app. Our application was noted as "received" on October 23, after the PR portion was received and matched up with the sponsorship app we had already sent. So I don't think you can start the sponsorship application without the PR application. Our sponsorship app should have been returned to us as incomplete, but the lady at CIC helped out by holding it until we sent the remainder of the PR app.
