Hi,

I am new in this forum and would like to be enlightened on how I will proceed with my PR application in January 2013.

I am a resident of UAE in the past 5 years. Last July 2012, I have completed my Permanent Residence Application under Federal Skilled Worker Class (NOC 1122) but I wasn't able to submit my documents due to the temporary pause on the acceptance of applications. That time, I was already issued a TRV which is valid for a year so I decided to use my visa and I came to Canada as a tourist.

Based on the proposed changes on the requirements for FSW Program, I am not confident that I will still have the 67 points required to apply by January. Please check if I have correctly calculated my points below based on my qualifications:

1. First Official Langguage 22 points
Speaking - Score 8, CLB 9 = 6 Points
Listening - Score 8, CLB 9 = 6 Points
Reading - Score 6.5, CLB 8 = 5 Points
Writing Score 6.5, CLB 8 = 5 Points
IELTS Band Score of 7.5

Second Official Language 0 points

2. Age 38 9 points

3. Work Experience 15 points

4. Education 21 points

5. Arranged Employment 0 points

6. Adaptability 0 points

Total : 67 points

1. Have I calculated my IELTS equivalent scores correctly?

2. My work experience and certificate of employment is under NOC 1122, Category A - will there be a new list of needed occupations in 2013 before I could submit my application?

3. There is still no announcement as to where I should submit my school credentials for evaluation. Is the evaluation only applicable to regulated professions? I checked the IQAS - International Qualifications Assessment Service in Alberta and found out that each application assessment will normally take 10 weeks or more for them to finish. Do I need this evaluation before or after submitting my PR application?

4. I have completed a 4 years Bachelor's Degree in Business Management + 10 years in Primary and Secondary School. Will my points be equivalent to 21?

5. Arranged Employment - I have accepted an unskilled job here in Canada (NOC 6421) and my work permit is already in process. I am aware that this NOC will not in any way support my immediate PR application unless I get promoted and be given a new approved LMO under job category A or B. Given this scenario, can I still submit my PR application in January? If yes, where should I submit it? It will be a TSW application inside Canada by then.

6. I have a niece and nephew who will be coming in Canada as a landed immigrant anytime in January 2013. Though I already have the required points above, I still want to declare them in my application for me to have adaptability points. Can I mention it on my application even if they are only scheduled to arrive in the later part of January 2013?

I will be expecting some of your expert comments on my case as I am not really getting the right advise from the immigration consultants here in Canada. For them, the point that I am already here is already a success but I find it difficult to make them understand my disatisfaction about the possible changes in my professional career. I am not a landed immigrant in Canada and I am missing lots of opportunities here because of my status. I really need to submit my PR by January 2013.

Kind regards,
BenB
