I am a US student and have recently accepted an offer to attend a university in Canada as a graduate student. I'm in the process of applying for a study permit with an open work permit for my common law partner.
The problem is I'm still legally married to my former partner. I have court documents showing that we split in 2014, the first divorce document was filed in 2015. The case hasn't finalized yet because my previous partner had a series of hospitalizations so we postponed finishing the paperwork. His condition stabilized recently and we are submitting the last of the paperwork but due to a mandatory waiting period it may not be official before I plan to go to school.
My question is, should I talk about this in the explanation letter? Should I upload any of this paperwork with my application? Do I upload proof of common law partnership with my application or do I bring that with me later when we cross the border?
