Hi guys,

As im looking more and more into outland application, i was wondering if its possible to get a study permit while we waiting for outland application. If yes can I apply to student visa which im in Canada. I'm just really afraid if they dont extend my visitor visa and i have to go back to usa and be separated from my spouse again.

I'm looking at any possibilities possible.

when a pr applicant (or someone intending to apply for pr) applys for a visitor extension, especially someone from a visa exempt country, it is very rarely denied, so i don't think you need to worry.

people definitely request a year, and for the most part receive it. there are the rare occassions where CIC will give you less than what you request, so that's why it's best to ask for more upfront. That way you don't have to pay to extend it a second time if your applicaiton hasn't finished processing.

If you're going to apply for a study permit, then there is no point in applying to extend your visitor status as well. You can have status as either a visitor or a student, not both.

It is perfectly fine for you to apply for a study permit if you qualify. Note that you ARE allowed to take a course that is less than 6 months as a visitor.
 
what I was thinking: we will apply for outland in September/October, then I'll apply for visitor visa extension in October 2014(since my 6 months visitor visa expires in November) and after that apply for student permit so I could start classes in January.

do you think its a good plan if I want to go to school here while my outland application is pending?

No, not a good plan. Current study permit processing times for LA and NY are 10 weeks and 17 weeks respectively. If you wait until after October to apply, you won't have it in time to start classes in January. You need to have your study permit app submitted by the beginning of September to ensure you will have it in time.

So no need to apply to extend your visitor status, as you will have already applied for a study permit.
