Hello everyone,

We are almost ready to send off our application package soon enough but we do have a quick question that I did search about on the forum but was never able to get a solid answer.

My wife's student visa is expiring on April 30, 2017 and we plan to send our Spousal PR application package by the beginning of March. My only question is, is she legally able to stay in the country while waiting for the approval/denial of the PR? Would this be considered something along the lines of "in progress" despite not being on a tourist/student visa after April?

1. Depending on whether it is an "in-Canada" or "out of Canada" application. If it is in-Canada she includes a spousal work permit application with the application, and has implied status until the work permit is issued, about 5 months. If it is out of Canada, she will have to apply for either an extension as a student or a visitor, if she wishes to remain.
 
Thank you for the reply PMM. I do need a bit of clarification however if you could kindly provide that.

This is an in-land application. From what I understand from your response, if we include a OWP application (which we originally were planning to), she will be on implied status the day the application is sent out and she won't need to apply for an extension on her student/visitor visa? Or would the implied status only begin once the application is received?
