can we declare as common law even my bf is not yet divorced with his ex-wife but they are seperated for 7 years and the thing is, he has a custody case that's why he can't divorce his ex-wife? we've been 6 years living in together so im just wondering if we can declare as common law..thanks
 
Yes, you can declare yourselves as common law. This is not-uncommon when there are good reasons not to get divorced. Some people even come from countries where you can't get divorced.
 
even he has a government case in custody and not yet divorce here in canada? there would be no problem if we declare as common law? and i have proof because he is one of my benificiary in my insurance.
 
Yes, you can declare common law but beneficiary of your insurance does not prove that you live together. It would be better if you have a common lease, common utilities or at least can show that you are getting a lot of mail to the same address.
