Statutory Declaration

Hi All,


I don't have birth certificate, never was issued one, a friend advised to provide a statutory declaration instead. do you advise?

I was born on December 23, 1982

on my passport only 1982 is mentioned so by default it is assumed that my birthday is on Jan 1st.


do I provide a statutory declaration with my actual birthday or just forget about it? please note that it is impossible to issue birth certificate

In India, if your birth is not registered then you can apply for "Record Not Found" certificate to your local birth & Death registrar and that is sufficient for the Visa officer.

I had the same case.

Search for "no birth certificate" on this forum.

I don't know exactly the situation of birth certificates in your country, why you say it's "impossible", but in some cases, a letter from the Consulate General of Canada in Dubai (your residence) or the Embassy of Canada in Lebanon (your origin) for your case can explain the situation in your country and verify your identity.

it is impossible because I have a file a case in court -technically to sue my parents- and then wait years to obtain birth certificate

Ah. Well, I was under the assumption that there was a country-specific issue that the Consulate General or Embassy could help with. If it's a personal issue like this, I'm not so sure now if they could help.

I consulted a migration lawyer in Alberta and he said I could go with the statutory declaration

CIC won't ask you for a birth certificate at any time during the process. Use the DOB as provided in the passport everywhere in your application.

If you're applying to a province who insist on birth certificate, an affidavit declaring the issue and explaining the impossibility of getting a birth certificate must be submitted along with the application.

It is for SINP, I was sent the below form, which I signed in their office and then got stamped.

In your opinion would it work?

I, Pascal H*** do hereby solemnly swear that I was born on 23-December-1982 at **** in Beirut, Lebanon at a hospital. My mother’s name is *** and Father’s name is ****.
I further confirm, that I have never been issued a birth certificate but instead was issued a Passport No. ***** from Republic of Lebanon, upon registration after my birth.
STATEMENT OF TRUTH
I confirm that the contents of this Oath are true and the best of my knowledge and belief.
I have sworn in front of a Solicitor.
