Hi All,

Please enlighten me with your opinions and suggestions.

Me (filipino) and my boyfriend (turkish) for 5 years has been living together in UAE together with my son. We have a lot of proof of our relationship (photos with his family and my family, joint lease contract, attested letter from our friends and family that we are living together since 2007). We are planning to submit Statutory Dec of Common Law Union. However, I was married but already separated for 6 years. Legally in Philippines, I am still married but already filed my annulment petition and anytime this month I will receive the Final Decision from the court.

My questions are :

1. Can me and my boyfriend declared that we are in common law union for 5 years?
2. Who will be the Commission of Oaths to sign the declaration?
3. Can I include in our application the final decision of the court even it is not registered yet in NSO?
4. What other supporting documents we can submit for this common law union?

Please help me as we are planning to submit our application this month. Your suggestions and opinions are greatly appreciated. Thank you.

I`ll try to answer your questions the best i can. Are you applying for Spousal sponsorship or FSW?

Yes, you can declare your Turkish boyfriend as common law. You have all or most of the evidence that is required for sponsorship.

Commission of Oaths is a Notary Public. Be sure though that all documents should be translated in English.

You need to include in your application the certified true copy of the court petition and court decision.

You need to submit an Advisory of Marriage (AOM), you can get this from the NCSO, this is on our regional checklist. This document will show that you had been married before, the name of your husband and date of marriage and an annotation that your marriage was annulled . So my advice is after you get the final decision go to the Family Trial Court where you filed your case to register the entry of judgment granting the petition for declaration of nullity or annulment of marriage and then to the Local Civil Registrar where your marriage contract was filed. The local civil registrar will annotate your marriage contract. Do the forwarding to NSO. ANNOTATIONS are made by the LOCAL CIVIL REGISTRAR by the decision of the court, and AUTHENTICATIONS (WITH ANNOTATIONS) are from NSO. Include this in your application to show that you don`t have an existing marriage in the Philippines. Ask your lawyer if he can do this for you for a fee.

Also include Joint Accounts, receipts of big purchases (preferably with your name and your boyfriend) and gifts, pictures with your son, Facebook pages if you have (family and friends are making comments). The list is endless but every relationship is unique so whatever evidence that can convince a visa officer that your relationship is genuine then include it.
