I have gathered all the forms and am starting this gruesome process. I am sponsoring my spouse who has been in canada for almost 5 years and is currently out of status as he overstayed his visitor visa. I know that being out of status is not a way of making you inadmissible but in the Spousal sponsorship guide it asks for :
"Immigration document confirming your status in Canada

Examples:

visitor visa,
study permit,
work permit,
temporary resident permit (TRP),
document proving that you have legal status in Canada"

I am stuck and do not know what to show for this.

You should read http://www.cic.gc.ca/english/resources/manuals/ip/ip08-eng.pdf as it deals with applicants with no legal status.
The relevant section is 5.27 (page 21)

How long ago did his visitor permit expire?
