Hi,

I have a valid I797 until 2022 but I don’t have the H1B visa stamped and last i94 was valid until Sept. 2019. Will I able to come back from Canada to US? I want to stay 2-3 days there. I think the I94 automatically extends with I797 as they need valid i94 within the automatic revalidation rule.

Thanks for the help!

1. There are multiple threads for the same topic but not sure why many open up new threads for same specific question.

2. what do you mean "you think". if you have i94 extended by uscis then only you can use it to reenter.

Your approval notice will have an I-94 at the bottom and wording of the notice will say something like 'extension of stay is approved' or 'status is valid as shown'. If that is the case, then you do have a valid I-94 and you can use AVR to return from Canada.
