Hello senior members,


Need assistance for spouse open work permit visa. I had applied in September 2019 for my spouse WP visa, howevre it got rejected. My wife is in India


Background : I have a post grad open work permit for 3 years, studied my MBA in Canada and I currently have a managerial NOC : B Category Job


My laywer filled in the Counterfoil Category: W-1, is this the right form for spouse work permit?

As per the below reason, I had pictures, whatsapp chat for 1 year and my call log of speaking to my wife attached including wedding photos and other photos, the officer mentions there is no proof attached.


My lawyer wants to do a procedural fairness, is this the right way forward?


The rejection reason as per the GCMS notes I requested for is as below

While I take note of the marriage certificate and recognize the legality of the marriage, I have concerns that the circumstances surrounding the marriage and relationship. The applicant has provided no supporting documentary evidence marriage and the relationship. The applicant has provided no supporting documentary evidence of marriage celebration/photos of the couple and proof of ongoing relationship since the marriage. Due to the above factors and balance, I have concerns regarding the relationship and I am not satisfied that the applicant did not enter this marriage primarily for immigartion purposes. I am not satisfied that the applicant is a genuine temporary worker who will depart Canada at the end of his authorized stay. Refused

Please advise what can be done, should I apply again or put in a procedural fairness???

Any additional proof that you could recommend that I should add?

There is no "procedural fairness" process. Just reapply with the relationship proof.

Hello! Can you please share your timeline? How long did it take to get the response? Did you apply online or paper application?
 
Ask your lawyer why IRCC seems to think the proof you submitted wasn't included.

As said above, you cannot do a "procedural fairness"
 
My lawyer is sure that all the necessary documents were attached. He seems to think that the officer has not gone through the file properly because the proof of pictures,whatsapp chats and call logs were at the end.
 
How much time have you spent with your wife in person before or after marriage? Was this an arranged marriage? Is she working or has a similar education than you do? Did you include proof of chats after you got married or only before?
