1.-Hi, so for the document checklist they are asking for option c and the question 18 ask for income. What if my husband(the sponsor) doesn't have income, his dad sends him moneygram money. (Because his dad lives in other country) And that's it. He was studying but now he is taking a break since his mom is sick. He has never worked here so he doesn't have any option C thing or taxes to report. What can we do about this in the application? I don't have dependands either is just me.

2.-Also, i have a question related to the family form imm 5669. Does all my family needs to sign this? Or do they need to have their own form done? They are not going to canada with me and they are not going to be my dependands. I just have my mom and dad, no brothers or sisters.

3.-If i do not have dependands do i need to fill the form imm 00080?

Thank you so much in advance, you are all very helpful.

1) if your spouse lives in Canada, he needs to file tax no matter if he has income or not.
2) I believe the form where stated "family", it means your children. (Father, mother, brothers and sisters are not considered as immediate family once you got married or become someone's spouse)

Hope that helps.

My husband has never filled taxes, how can he fill them if he has never worked before? i don't know what to do!! I'm scared!! And we are planning to send a letter telling them that he has been getting income from his father all this years and that he is planning to study again as soon as i get to toronto as a resident

Do you think cic will mind if his dad will be sending him
Money to supoort him and myself?

No sense worrying, best to focus on what you can do. Your husband should write a note explaining why he cannot get the option C's, and has not filed income tax returns. He should also provide evidence of where his income is coming from. The letter you mentioned will be good too.

As mentioned above, taxes should be filed even if you are not working and earning an income since you can be eligible for GST etc.

My friend filed his taxes for 4 years last season.

Since there is no income requirements unless you have dependents the letter will suffice.

The letter should explain how he has been supporting him self and how he plan to support you - This can be in planned studies etc.

Hope that helps

Yes, you should file taxes even if there is no income. As part of this process, I think it would be best if your husband goes to a tax consultant and gets his taxes filed. It will help in any case regardless of what happens, as I think not filing taxes is a crime - you could be fined for not filing taxes (Section 238 of Income Tax Act). Then you can either wait for Option C to come, which will take a year, or explain saying I just filed my taxes for the last so many years, and therefore I don't have option C. I think it would look really bad if you don't file taxes now and say, I didn't file, I don't plan to file, I have no Option C, but I want to sponsor my wife.

Easy on paranoia! If you do not owe taxes, it is not necessary to file a tax return. It may be beneficial to one to do so, but it is not necessary! This is what the Canadian govt has to say about the issue: http://www.cra-arc.gc.ca/tx/ndvdls/tpcs/ncm-tx/flng-blgtns/menu-eng.html

From my own experience, I did not have a problem getting sponsorship approval when my tax filings were not up to date. I am not recommending anyone do what I did, but want to mention it to demonstrate there is no need to be overly concerned about filing unneccesary returns.

When I applied for sponsorship for my spouse 7 years ago, I was a year behind in my tax returns. Last year when submitting additional documents for sponsoring a parent, I was 3 years behind in filing my tax returns. In both cases, I wrote a note explaining the issues I was having in getting my taxes finalized. It was not a problem!!

Answer every question, and be straight with CIC and everything should work out fine.

Well, we are all hoping for a quick PR schedule here. I stand corrected, you may not get fined for not filing your taxes (I always thought filing taxes was mandatory). But, you would have to agree, the file would look a lot better if at least taxes are filed. For one thing, if the taxes were filed on time, there would be an Option C available now right? To go to them now and say, I still haven't filed simply because...I don't want to...and I'm not required to, so why bother...but I want to sponsor my wife.

It will probably work out, but not in a clean quick way.

I thought the option c was mandatory and if not a detail letter has to be included why not.

I remember seeing you have to submit for one year preceding your application, employment etc
