Hi guys.
i want to discuss my case with you and need your suggestions.
my ex husband and me together landed as a PR in canada at the mid of 2022. After 15days, he went back to pakistan and sent me divorce paper at my address in pakistan.
I want to know if i marry again at my homecountry how can i be able to sponsor my new husband to canada. First do i need to live with my new husband whole 1year? Then i will be able to apply for him? Its a long process. Is there any other way through which he can come here in minimum time?

Who is the main applicant? You would need to wait and then return to Canada to start sponsorship. You cannot sponsor outside Canada.

Five-year sponsorship bar for people who were sponsored to come to Canada as a spouse or partner
  • If a spouse or partner sponsored you, you can’t sponsor a new spouse or partner within five years of becoming a permanent resident.
  • This rule applies even if you got your Canadian citizenship within those five years.

So 5 years...in 2027. You need to be living in Canada and meeting your residency obligations to sponsor your new husband. You can get married and it will be acceptable if legal. He can immigrate on his own merits through Express Entry.

I believe the bar on sponsoring does not apply to someone who was a dependent on another's PR application, only when the PR was obtained directly through spousal sponsorship. I'd be grateful for others to confirm though.

Yes u are right. We both got our Pr together so i think in my case there is no bar of 5years to sponsor my new husband.

There is no bar of 5 years in your case.

In Canada, divorce usually take a year's seperation. I am not sure how that works in pakistan. But as long as you are considered legally divorced, then you can re-marry. As mentioned above, you need to be in Canada to sponsor your new spouse.

There is no rule to live with new spouse for 1 year before you apply to sponsor him. But getting divorced and re-marrying so soon may be a red flag.
How did you and your new spouse meet? Did you spend time together before marriage? Is that the cultural norm there in your country to get married within a year of divorce?

There is no bar from sponsoring a new spouse but your situation raises a lot of red flags. There will be concerns about your original PR application and landing and whether you were in a genuine relationship at all and still in a relationship when landing in Canada. If you were immigrating to Canada as a family why was he the only one who left after 15 days? If it was a short landing both spouses normally leave together. How many years had you been married before divorce was filed? Do you have any children? How soon did you apply for PR after getting married? Has your ex remarried already? Would you have qualified for PR on your own? Were you still living together and not dating any other people before coming to Canada. Would anyone around you consider you separated or on a “break” from your relationship at the time of your landing? Depending on your answers the will be more or less concern

In our country we can marry again after divorce whenever we want. There is no restriction of 1year in our country. We can Marry immediately after divorce.
My new marriage is totaly arranged. We didn't spent time before marriage.

My previous marriage was in 2018 and we apply for PR in 2020 together. I took long 2years to get pr. we got it in 2022. After landing he said he is going to see his mother and after going back to pakistan he sent divorce at my address.
after divorce my parents did my arrange marriage with some one else. Which is my new spouse.
