Hi All,

I have applied for Canada PR last year under RNIP along with my wife. However, things were not going well from last 6 month and we decided to take Divorce. over first motion of divorce had already been done in last month and I have also informed to IRRCC immediately and declare my wife non accompanying. but now they are asking for my wife PCC and medical along with divorce certificate. although I could try to get divorce early by submitting a waver application for 6 month cooling period but my will definitely not support in PCC and medical. even if she will get to know, I have declare her non accompanying, she will not give me divorce. can you please advise if I will get divorce from her, do I still need to submit her PCC and medical?

You need to exclude her from your application. Declaring her as non accompanying doesn't fix an issue.

You don't need a divorce paper for that but expect delays with your application anyway.

1. You need to show evidence attempt that you tried and she refused- send screenshots of message, WhatsApp or email .
2. Write cover letter explaining it and ask to remove her from your application

You can provide IRCC with you court file details and a cover letter (preferably notarized) citing your current scenario and that its not possible for you to provide her PCC & Medical
 
Thanks for your reply, based on your advice I sent several emails to my wife, but she didn't reply. so, I have given the copy of all those emails and sent a cover letter as well explaining that I had provided you both PCC and medical of my wife when we were together, however, we have not received further response from you in last 6 month and both PCC and medical got expired and now we are in process of mutual divorce and first motion is also done and I can't force her much. now they have asked me to sign form under humanitarian and compassionate relief that I will not be able to sponsor my wife in future. could you please assist me what could be their possible final decision.

In my case they accepted it and removed my wife as my dependent. My non accompanying kid is still a dependent. Considering you in a similar situation, once you sign the form and share, they would mark your case decision complete, roll out Portal 1(P1) email asking for few personal details. Based on the P1 info they would create your PR Portal account and share the details over email - called Portal 2 or P2. Then comes the wait - 1 or 2 months for eCOPR or electronic confirmation of PR and another 1-2 months for card dispatch

If you don't have any other issues in your application other than the spousal issue and once you sign the form that you wont be sponsoring your wife in future - then I would say 99.99% your PR is confirmed

Congrats, this means they are considering your request- I am not sure as they have also mentioned "SIGNING THIS FORM DOES NOT ABSOLVE YOU FROM THE REQUIREMENT OF EXAMINATION NOR DOES IT MEAN THAT YOUR APPLICATION WILL BE APPROVED".
Would you mind sharing your timeline , how long it took for you after AOR?- I received it last year.

I too had that and mine went through. If they are convinced that your case is valid and your wife is not agreeing to undergoing medicals n PCC,they will consider just yours
