Hello Everyone,
I had submitted my spouse Permanet Resident profile through an agent 3 months ago and It got rejected with IMM5406E form incomplete/ not present, he is saying they had call CIC and it's a technical error from their end.

After visiting my consultant personally, he told me also I can apply for visitor and open work permit application, and when my spouse come here, we can apply for inland Spouse application, Or I can reapply the whole file Spouse Sponsorship file with new portal. Feedback what Im getting is usually visitor visa gets rejected.

Your valuable feedbacks are needed, which way we should go ahead with? We are really confused.

Getting TRV approved for spouse is hard luck. lot of rejections.. but you can try your luck. Btw why can't you submit the sponsorship application again?

Getting TRV approved for spouse without a sponsorship application in progress is really hard luck, but you can try. Btw I would go for sponsorship application first before applying for TRV.

Just to clarify, you cannot apply for an open work permit now. You can only apply for an open work permit if your spouse is able to get a TRV and travel to Canada. You can then submit an open work permit with the inland spousal sponsorship application.

The only option now is a TRV.

"Length of undertaking is 3 years from the day your spouse, common-law partner or conjugal partner becomes a permanent resident."

And now I am confused about whether I should file for it or not now and wait for 3 yr to complete.

What to you mean by "wait for 3 year to complete"?
Did you sponsor another ex-spouse in the last 3 years, and he/she landed? If so, you need to wait for 3 years after he/she landed before you can sponsor another new spouse.

If you didn't, then the statement means that once your sponsored spouse has landed as a PR (when the process completed and approved), you as a sponsor is reponsible for your spouse. If your spouse get any social assistance, you need to pay the government back. (doesn't matter if your relationship break down or not)

And this has nothing to do with visitor visa.... ??
