Hi,
This my first post here , so kindly disregard any small mistakes. Me and my partner had a arranged marriage. For immigration purposes we registered our marriage last year eventhough she was not physically present. We went ahead and applied for trv which got rejected because of her strong ties to canada. Later, we got married in the church this October.
The issue that i am facing is how to answer the 'were you physically present during marriage ' qn in pr application for her. She was not physically present during the initial registration but we had a big ceremony in church later with all the relatives in her presence .
If i answer no to the qn i will be ineligible for applying and if i said 'yes' , they can check the passport records and see that she was not in the country.
Just to add to the irony, she left her job in middle east to come to canada after marriage. I don't want any misrepresentation, but also want to submit my profile asap. Already called to ircc, they were of no use. Plz help

IRCC doesn't recognize proxy marriages. So IRCC will not recognize the marriage registration since you both weren't there in person. It was a mistake to do this.

What was the church ceremony? Was it more of a celebration or was it an actual legal ceremony where you got married through an officiant. In other words, if the proxy marriage registration has never happened, are you still legally married as a result of the church ceremony?

Do not lie about the fact she was not there is person for the registration. All that will end up happening is that she will be banned from Canada for five years for lying.

You may have created a mess for yourself.

Yes, i do not intend to lie or hide that fact.
Registration process back home is a lengthy 30 days process. So i am hoping that there are other people in my boat.
Also, the church ceremony was an official one with Registration and an officiant, with around 800 witnesses. We also had 3 other programs in which around 1000 people were present.
if the proxy marriage registration has never happened, we are still legally married as a result of the church ceremony. But as there can be only one marriage certificate, we are stuck with the proxy marriage date in that.

I do not know the specifics of the legal framework in your country (India?). But if you had a legally binding marriage that was carried out in a church, there should be a document demonstrating that - and I would show THAT date and document to IRCC.

If you show the registration doc and it was for a not-present ceremony - IRCC will simply say that is not a valid marriage. (How can a subsequent one be valid in-country if you were already legally married under local laws?)

That said: my best guess and I may not have sufficient info esp about legal aspect.
