Actually my brother didn't declare his son cos when I sponsor them 2009 we didn't change his status anymore
And he doesn't have a custody yet to his son, how can we get a full custody to his son is there any we can do?
Is in it normally the mother will get the full custody to the Childers?
My brother is so worried now that his not going to get his son to come here.

hi po. Medyo complicated yun case, kaya mas mabuti to get a lawyer. ang lam ko at a certain age, till 7years old yun child, automatic mother ang may full custody but there is an exemption (kun may default yun mom) to all rules.
wag masyado magworry, there is always a solution to everything

We have a family friend who has the same case. When our friend petitioned her parents and siblings, one of the sibling did not declare the daughter. It has been three years but di nya pa rin makuha yung anak nya. Kasi hindi naka declare. You will need a lawyer for this. Mas mabilis if your mother marries the mother of the kid. Though if nasa birth cerificate pa rin ang name ng brother mo, masisilip ng immigration na hindi naka declare before. Immigration won't make it easy for him.

There are many cases like this which have been denied. The rule was, if the person was not declared in the application, that person cannot be sponsored and the immigration is really strict about it. I have seen news articles na three years battle na sa immigration. Ilang beses na appeal, but denied pa din.

i think this will gonna be a court battle,but if your brother is supporting his son finacially and have official receipts,has constant communication with him and most if the mother of his son doesn't have a job to support her son then there is a possibility your brother will gonna win the battle and one thing more if his son is 7y/o anfd up..

Yess! My brother is supporting his son financially and contact him everyday.
Actually the girl is not working and she's having personality problem, she said to my brother
She wants to find herself and leave the child to her parents, yes this is gonna be a battle for us
But we're not going to back down we wanna get his son without the mother,
My relatives back home their saying she's having an affair.

Kasi naguguluhan ako.. Kasi before sila nagmigrate sa Canada, magboyfriend and girlfriend na kami.then 2 years kaming magboyfried-girlfriend nung pumunta sla ng canada.. after a year umuwi sya dito para pakasalan ako.. and nabuntis ako kagad.. then after 2 months ng kanyang visitation bumalik ulit sya sa Canada. ang concern ko po dun sa tanong n yun is kung icoconsider ko ba yung pagbisita nya sakin Simula nung mgaboyfriend girlfriend kami or magsisismula lang ako nung ngmigrate sya sa Canada?

lagay mo lang na mag bf gf kayo and explain mo na that was before he migrated. then lagay mo yung times na nag visit sya. dont worry of kulang ka ng psace just attach extra pages. be sure to indicate na may attached ka na page for that.
