Hi guys,

I was in Canada as a student however I was ineligible for any pr pathway so I decided to return back to my home however i left and I had some unpaid debts and I have a girlfriend in Canada and if we get married will this debt affect my spousal sponsorship

Why not pay off the debts? When are you getting married?

It is a big amount. Not sure end of this year maybe I just needed to know if it will affect my application

Should not impact PR application since you are married. But whoever you owe debt too will be happy when you enter Canada so they can go after you for the funds owned especially if it went to collections. If you have creditors, they can garnish wages once you start working in Canada.
 
Will impact your spouse so hopefully you have been upfront with the amount of debt you will be bringing into the marriage.

No won’t affect your application

But by now your credit score will be in the toilet . And you can pretty well forget getting any further credit

As well some companies run credit score checks when people apply for jobs .

And saying it’s a big amount is no reason not to repay

I think there was a misunderstanding when I said it’s a big amount. It’s a big amount to pay one time as now I am paying it monthly just needed to know if it was going to affect my application

Since you never stated you were in a payment plan , that’s why it was mentioned

The only way it will impact your application is if interviewed your spouse could be asked to confirm your amount of debt. Your spouse also has to show she can support her family in Canada. If you are already repaying it shouldn’t be an issue.

  • When I applied to PR on late 2022, I stated I was single.
  • Cut to April 2025 we moved together into an apartment & got married on Aug 2025.

Questions:
  • Will my PR application be considered as misinterpretation for being Single ( because both of our addresses would match for last 3 years) ?
  • Current processing timeline is 24 months for inland & 15 months for out land. We want our travel options (in & out of Canada) to be available while spousal application is processing. Which option to go with ?
  • When applying outland; We want the option to apply for OWP when her PGWP is about to be expired.

if someone was in the same boat your inputs are highly appreciated.

1) It's possible. Dates matter, specifics matter, and you have not clarified when you became a PR and when you started your relationship. Honestly, suggest you speak to a lawyer.

I want to emphasize: this is EXTREMELY important. If they decide you were common law before you became a PR, you will never be able to sponsor your spouse. You need a lawyer as much so you can be completely honest and be completely aware of all aspects (I say this because long experience seeing applicants, ahem, 'changing their story' when relating basics on this board once they realize the importance.)

2) If you want ability to travel without issues, outland. Note, even outland options require the PR-sponsor to remain resident in Canada (short visits are ok though).
3) No impact. You can apply for OWP after AOR is received, as long as applicant is already/still in Canada at that time (no longer any difference or restriction between inland/outland). Note, it can take some time, so you should apply as soon as possible after getting AOR.

Follow up on 1)
  • Timeline:
    • Put EE file on June '23 for PR
    • Got ITA July '23
    • Applied with complete application Sept '23
    • Received CoPR Feb '24
  • Relationship dates,
    • We were dating since Feb '22. But our intention to get married was not until Oct '24 when our parents got to know about our relationship.
    • We had several other roommates between this period until April '25.
    • We were not sure of our marriage until our parents agreed because. We are inter religious couple, which itself is a big story to explain.
