Hi,

I have a question about spousal sponsorship that I want to ask anyone in this forum who can possibly help. So thank you very much to those people that might provide some ideas!

I currently has PR and landed in Oct 2016. I met my boyfriend in Toronto and I really want to spend the rest of my life with him. However his situation is very complicated.

He came to Canada in 2009 with study permit. After that he got his work permit, but last year (2017) he filed refugee application and been denied. So he got Departure Order but he didn't leave Canada after that. We met after this and his Departure Order may have turned into Deportation Order since he been stayed in Canada after 30 days once he got Departure Order. Now we want to get married and we would also get a baby if that helps us get him PR through spousal sponsorship. But I also want to make sure of it before I get pregnant. Not that I am still hesitated, only because I am scared if I'm here in Canada with the baby alone and Canada government won't grant him to live in Canada.

We went to 3 lawyers before I post this on the forum. All the lawyers said that it will work as long as we have a baby since that is the strongest proof of our marriage. But I also heard that it will be very difficult because he got deportation order already and he stayed here illegally. Some friends told me that lawyers guaranteed a PR for him as long as we have a baby also because the lawyers want to make money. That's the reason I post this and hopefully there is anyone can provide some advice or previous experience. Also if anyone knows once we have started the application, our option will be inland or outland application for him? We probably will start the application after I'm pregnant or have a baby already (the lawyers told me that is the best thing to do because we haven't been dating for a long time), inland application if possible would be great that he could stay with me and baby in Canada during application.

I'm very stressed now and hopefully anyone reads this post could understand what I am asking. I am very appreciated for anybody replies!

A baby has NO bearing on a relationship and PLEASE dont bring a baby into this world soley for the purpose of his visa. Seems youve been given bad advicr about having a baby.

I don't really know much about this, but from reading a few posts, I would be very careful about this. I do not think you can just marry him and apply inland or simply just get pregnant/have a baby and assume this will all go away. If he's received a Departure Order he needs to leave the country. I think if you apply for a visa and they find out he is still in Canada, they will come after him to remove him. I think he will have to go through a process of being allowed back into Canada. Having a baby does not prove a marriage and will not help a spousal sponsorship app. How long have you actually been together?
 
Anticipate that even if you get pregnant your husband could be sent back to his home country and you may have to fight for his spousal sponsorship for many years. You would be alone raising a child during that time which could be years if they suspect that your marriage is not a true marriage. People go to extremes to avoid deportation like getting pregnant so it is not proof of a true marriage.
 
We had a 2 year old but I was still deported and given an exclusion order of 1 year for overstaying my visa. They dont care if you have a kid.
 
Don’t worry as long as your application get s to AIP they would back off and let the process complete.
 
I have been in a court for exactly the same scenario, the only difference was that the woman was pregnant and on her last months. It was their third judicial review and it has been denied after the forth one. They had great great support for their case but the Member did not convinced that the marriage is Genuine and not because of getting a Canadian Status.

You need to show that your relationship is genuine, babies have no bearing on the final decision. I have a daughter and it never crossed my mind 4 years ago that I will have a baby just because I want a PR for my partner... We're doing PR now because I think we are ready to has a cpl to take the next step and bring my partner to Canada together. I wish you figure your stuff out but please don't bring a baby in this world just because of a PR.... What will tell your child when they grow up? Well, we brought you to this world because of a visa.... NAH!! don't take that route;) good luck
