hi!

I would like to ask others opinion on my situation

what is the best option for me to apply my partner. I am now a permanent resident I wasnt able to apply my partner before because I was previously married (but physically separated for about 5 yrs and have an affidavit about that) and my status when I applied for permanent resident is still married for I cannot file a divorce until a year of stay here in saskatchewan. My partner is currently working in here in canada as temporary foreign worker and working permit will expire next year.

I have already applied for divorce and waiting for the decision. If I file my partner as common law we need to wait for a year because we need to live together for atleast 1 year as part of the requirements. If I will marry my partner after my divorce is there going to be a problem? Our problem as well is that we cannot find a witness like my family or friends here for we are keeping our relationship secret because of my previous status and our family will not accept our relationship.

Currently we are 3 years in our relationship and we can provide some proof if needed like photos, greeting cards, gifts and joint account. I was really hoping that someone could give an advice

In order to sponsor your partner, you need to be either married or common law (have physically lived together for at least one full year).

So you will either have to wait until you have lived together for a year or wait until your divorce is finalized and then re-marry.

You cannot apply as a conjugal couple since there is nothing stopping you from becoming common law.
