Spousal sponsorship denied what’s next?

My friend sponsored his wife to come here back in 2017, it was denied because he didn’t include her on original paperwork when he was sponsored here in 2013 by his sister, (they were married after applying but he didn’t think to update his file) appeal was also denied… fast forward to 2021 she submitted for a visitor’s visa do you think it will actually be granted or do you think they will assume she will overstay? And if she gets here and extends and they live together for a year can they apply on humanitarian grounds? (They have a kid together) Anyone with a similar situation?

To get a visitor visa, she needs to show funds, travel history, ties to home country and reasons to travel. Given her spouse misrepresented himself to get PR and the fact that her appeal for spousal sponsorship was denied, her chances are very low. Where is the child, where was the child born? What is the basis for humanitarian grounds given her spouse lied to get PR?

She has a job, but not much savings, no real ties to home country, their daughter was born in Nigeria and the application was done for both as she will be coming with mom, apparently they are at the stage in the application where they are requesting criminal background check on the wife… does this sound positive?
As for humanitarian I’m not sure, but the man just wants his family together and doesn’t know how else to go about it.

Criminal background check for a TRV is just part of the process. Has eligibility review started? Is the application for her and the child too? Was the child born after or before he received PR? If after, he can sponsor his child but never his spouse.

So her TRV profile is not strong. She can look at immigrating on her own merits. Maybe study in Canada.

unsure if eligibility has begun, he seems to think criminal background check is the last step, but I don’t think he’s correct… child was born after his PR

The big issue is that he never qualified to get PR because he was married. Has he applied for citizenship because his status In Canada could technically be at risk. Unfortunately by lying and securing PR he has made spousal sponsorship almost impossible. He should really be consulting a lawyer for his best chance at securing sponsorship.

Chances of TRV for the wife are almost zero after a failed spousal sponsorship and due to minimal ties to her home country.
